Hi All,

 
I’m from India and my wife is a US Citizen. I’ve filed for CR-1 in Nov 2021 & still awaiting approvals on i130 (Consular processing). 
My current employer has agreed to sponsor an L1 visa for me & traveling to start work by Jan 2023, but I am confused on how to move forward. 
 
I have couple of queries : 
  1. I am anticipating my approvals for i130 before end of this year. Can I do adjustment of status (AOS) in US with my approved i130? Do we foresee any issues? 
  2. If 1 is not possible, can I come back to India for interview?

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Standard L-1 visa processing usually takes between 6 to 12 months. This includes processing of the I-129 petition, which can take up to six months, and consulate processing which can be expected to take up to six months or longer.

Thank you! Since there is a choice on the i130 form to select between Consular & AOS, I would also want to know if I need to submit an i824 if it reaches the NVC

Thank you for providing this information. My understanding is that my company is submitting for Premium processing, which might reduce the processing time to a few weeks.

No I-824 needed , when it reaches NVC, do nothing, do not pay the fees . As long as you make contact w NVC once a year, case stays active .

When you come on L-1 and are ready to file the I-485 based on the marriage, include I-130 approval and or NVC case letter , they will send to USCIS. ( only the reverse requires I-824).
