Working abroad for DoD not proof of domicile?

Timeline

We finally heard back from the NVC today and it said the sponsor (my husband) might not have domicile in the U.S

 

We live in Germany where my Husband is working as a dod contractor for an American contracting company. 
 

We added all of his tax returns/w2s as proof. 

But they still said no. 
 

What else can we provide? He hasn’t voted on decades, doesn’t own property there or have a physical address in the United States. 
 

 

IR 1 Green Card
07/06/21 - I-130 sent
04/21/22 - I-130 approved
04/22/22 - NVC received + paid
04/29/22 - Submitted DS-260 
09/15/22 - Case completed at NVC
10/04/22 - Case left NVC
10/11/22 - Consulate received case
10/19/22 - Interview scheduled
11/17/22 - Interview date
Approved on the spot! 🥳

Reentry Permit
05/11/23 - Fee accepted
06/05/23 - Biometrics taken
07/12/24 - Reentry Permit produced
07/13/24 - Case approved!

N-400 
07/16 - filed under 319 (b) (Washington Service Center)
07/16 - received Receipt Notice

I'm not sure what your point is.  Clearly he is not domiciled in the US.  It is more than just paying taxes.

 

Working as a contractor for the military does not exempt the petitioner from the domicile requirement.  Most people find they need to move back to establish domicile.   Unfortunate that he didn't maintain his voting record and other ties.

The domicile requirement is proof of physical address in US.  That is the whole purpose of why u filed DCF.  You have to show proof of rent/lease, utility bills, bank accts in the US, filing taxes, voting, among other proof.

Try  having your husband write an “ affidavit of intent to re establish domicile “ , simple statement detailing the how/ when’s of his plan to return home as soon as contract permits. 

1. If you have family in US that could be designated as permanent US address, have them write a letter stating you will live w them immediately on entry, and that you two can live with them as long as you wish. Update that address for everything ( taxes, bank, credit cards…) 
 

2. Have hubby take a quick flight to US and renew his DMV drivers license w new address ,  register to vote

 

3. Move some cash to a US account

I am in the same boat.  Showing that you have your retirement accounts in a state, a state's driver's license, an address, and in my case my W2 has my address in my home state.  And plus I vote.  Given all that shows that I am domiciled in the U.S. and my residence here in Germany is just temporary.
