Is it okay if beneficiary gets Canadian PR while K1 is in process?

Other than possibly having to get a police certificate from Canada and most likely waiting longer for an interview if she switches to the US consulate in Canada, it would not ‘interfere’ (actually not sure what that means, I assume you’re asking if it would have any negative consequences on a K1 process).

Thank you for your response! Yes I meant if it has any negative affect on the K1 process.

What would the police certificate be for?

K1 applicants are required to bring police certificates to the interview from any countries they have lived in for 6 or more months (starting from the age of 16)

the person can interview in Canada as permanent resident

but will probably go into extended security checks for his India background checks which is longer AP after the interview

They will go back to India in a few months and will be interviewing from India. But just getting a Canadian PR while K1 app is still in process.

A contrarian answer from me, as usual.

As I am dual citizen, when my then fiancée’s CO asked her in her K-1 interview, did she plan to live in Canada or the USA, my fiancée was quick on the uptake and immediately said: “USA”. Hence her K-1 visa was approved.

If the CO is aware you have or will have Canadian PR, expect to be asked what your plan with status is. Consider your answer carefully, and produce one that is both credible and not likely to cause your visa application to be denied.

And no we don’t plan to live in Canada.

Sorry if this is a dumb question but just wanting to make sure.

If the beneficiary is currently in India, then comes to Canada and gets a Canadian PR while K1 is in process, does that interfere with the K1 process at all? I wouldn’t think it does.

Thanks

No issue. But she must make it her intent to make her primary home in the US and communicate as such to the CO.

Canadian PR requires 2 years out of 5 in Canada over a rolling period to be maintained unless you are living with a Canadian citizen spouse or common-law partner. This is known as the residency obligation.

If you live close to the Canadian border it is possible to maintain US LPR and Canadian PR at the same time provided you make the US your primary home. I was a 'double PR' for around 10 months until I was granted Canadian citizenship a few weeks ago. :)

That’s a good point, I haven’t thought of that.

longer for Indian whether does interview in Canada or india

as the CO will do extra security checks (read post from India portal) and india is poor on record keeping

some checks can  take a few weeks,  some a few months or more
