CR-1 to IR-1 Conversion

Hello, all. 

 

My husband and I recently received word from the NVC that his paperwork was accepted and that his interview will be scheduled soon. We were married in December 2019 and began the process of filing for a CR-1 Visa shortly thereafter. Fast forward 2.5 years of delay after delay and we are now approaching our 3 year marriage anniversary. Since 2+ years of marriage would qualify us for an IR-1, what does this mean for us once his interview is complete and visa is issued? Some cursory reading I did gave me the impression that it will be converted automatically when he arrives to the US, but I wanted to confirm this. Do we need to do anything on our end to make sure that conversion happens? Should he ask during the interview? Obviously we would greatly prefer to obtain the IR-1 since it would save us some money and time removing the condition for his green card in the future. Any and all thoughts are appreciated.

And if not, file an i-90 and report their error (for free).

You don’t have to do anything.  It’s already a hard-and-fast rule based on when he comes through POE.  Let’s say you were 23 months married and he arrived today, the green card would be issued as a CR-1 type.  If he put it in a drawer and waited a month to come the same approved visa would then become an IR1.

There is no CR1 visa or status yet, so nothing to "convert".  Up until now, CR1 is just in your mind.  The appropriate visa is what gets issued, so it will be no IR1.  Not a converted CR1, just an IR1.
