Timeline

I am the main sponsor for my wife.

 

My father is the joint sponsor for my wife.

 

We will use cash assets from my fathers checking account because both of us showed low income. 

 

My fathers (joint sponsors) 2021 total income was $12297. Himself + has 1 dependent + my wife = 3 household members, poverty guide $28787.

 

 Quick math the difference is $16490.

 

My fathers 12 month checking account balance average between march 2021 - february 2022 is $53000. 

 

NOW uscis.gov says 

Quote

Sponsors of spouses and children of U.S. citizens must only prove assets valued at three times the difference between the poverty guidelines and actual household income.

  1. Does this work for both main sponsor and/or joint sponsor assets ?
  2. From which point do they take the 12 month average is it the signed date on the i864 form (12 months before march 2022) or is it the date they check files (12 months before july 2022) ?
  3. My father got a $95000 small business economic injury disaster loan from the government during the pandemic which makes a big portion of the cash. In the bank statement description area  It just shows as ''SBAD TREAS 310 MISC PAY''. Will they understand that and ask about it or deny it since its a loan or will they not even look at that ?

I would suggest finding a different joint sponsor. 

I don't know if the folks at NVC would be familiar with the description of the transaction-  its distinctively recognizable as 'treasury'. I believe those funds were provided for specific purposes- providing support to an immigrant was not one of them. Father can risk getting in trouble for doing so. I mean I've seen lots of articles about people getting snabbed for using their pandemic funds improperly- cars and vacations etc. 

 

I really don't know though. Perhaps @pushbrk has more specific information on the topic of pandemic funds/loans for 864 purposes. I would find a different sponsor though.

would it be easier if my dad just writes me a $70000 check and i upload a new i864 ?

$53K balance is just marginally above 3x $16.5K, very likely it won't be accepted.

They will absolutely ask about it and once they know it as a loan, may not accept it.

You dad can but they will want the info of the source, that means you need to provide all details on how your dad got that money. Back to loan disclosure which means it will likely not be accepted.

 

Overall, they will very likely not accept using covid business disaster loan as an asset for sponsoring someone. Better to find anither joint sponsor.

A qualified joint sponsor is going to be needed in this case, in my opinion.  You could try this.  It MIGHT work, but I doubt it.  

 

Note that Dad hasn't used the funds to support an immigrant.  He would have declared and documented his liquid assets, that have not been "used" for anything. 

 

Still this is marginal.  I don't recommend marginal.

would they accept money that just came in a couple days before the review ?

 

and if so how can i go on with the process of 'gift' money ? what are the guidelines

They can accept it but it the source has to be verified to make sure it's not black money. You need to provide documents on how your father got that money.

This will not solve the issue you have asked about before, regarding your father using money he received from a pandemic loan to be a joint sponsor. In fact I think this would be worse, since gifting it to you is blatant misuse of that money. Not sure that's a rabbit hole you want to go into, or drag your father along for the ride.

ok so instead of gifted money how about this:

 

So they asked me for proof of income 5 months ago and just to make sure i had uploaded my proof of income with my father as a joint sponsor , unfortunately i uploaded the him on to my page as well and they sent this message.

now i find out i maybe cant even use him as the joint sponsor.

but at the same time they accepted all my documents

Now im not sure if i need a joint sponsor at all because they didnt even ask for it in the first place i just uploaded it on my own. 

i also had to amend last years tax returns, my amended adjusted income is $31000 for 2020. $24500 for 2021, i also have an employment letter saying i make $42000 annually and that ive been working there since march 2022.

do you think i should send in a new i864 with my amended tax returns even tho they have accepted the previous ones ? 

i can add descriptions to why i added a new i864 even tho the previous one was accepted cause of amended taxes etc.
