W2 Forms unavailable for Petitioner

Hi everyone,

 

My wife is currently working abroad, in the same country as myself. She has enough to prove her domicile in the US, but she does not have W2 forms.


On her most recent tax return, she filed as "foreign income", before that she was a student so had 0 on her tax return.

 

Her dad is jointly sponsoring me, and he has his W2 and tax returns etc.

However I saw on the NVC website that they always ask for the W2 of the petitioner.

 

What should we do? Submit a statement as to why she doesn't have W2 or submit the UK equivalent (P60) form? Or both?

That is not accurate.  They didn't ask me for any W-2s.  Not everyone receives W-2s.  She can submit a statement regarding her foreign income, and she MUST indicate either her tax information or the reasons why she was not required to file taxes on the I-864.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Ah that's good to know, thank you. She did file taxes, so we can submit those, it's just that the income was "foreign income" due to the job.

If she can obtain tax transcripts, that would be ideal.

Hello,

 

They requested the same from me also. My US Tax Transcript clearly states it was foreign income (I lived and worked in Greece for the last few years), I got internally transferred from the Greek office to the Las Vegas office. My 2021 salary clearly passes the poverty line, and also gave them a letter of employment stating my internal transfer and my new salary which is even higher than 2021 and yet got a RFE asking for my W2 forms for 2021. Now we have submitted a letter saying no W2 forms exist in Greece. I'm thinking of uploading my YTD pay also from my current job which is already past the poverty line also. 

Any tips would help and hoping anybody still separated from their families finish with this torture sooner rather than later.
