06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

And after much discussion it was established that it didn't matter what the users on VJ felt personally about the topic- it is covered in immigration policy.  Once the visa is issued the visa holder is able to use it regardless of any personal issues the couple may have. So immigration law says if he is in possession of a valid visa he can use it. Im sorry if you disagree with the advice given but it is the correct advice from a legal standpoint. Whether he should come and fight for his marriage or if it's wise to do such I am going to refrain from commenting as too few details were provided despite repeated attempts by @family for a more complete story as to whats going on between them. 

Yes, but I wasn't speaking of "legally right," I was speaking of "morally right." This person is going to show up in the US...yes, legally. But then what? If the spouse still doesn't want anything to do with him? What then? Does he sleep at the Greyhound bus station? I used to work at Ken's many years ago ...you know, they make the salad dressing; in the short time I worked there, everyone I worked with spoke no/very little English. I did have the opportunity to drop a guy off at his apartment one afternoon ... there were like 20 other guys in a one bedroom apartment....basically a flop house...so yeah, I question the American dream that you have anticipated for this individual; but yeah, it's "legal." 

 

AND, apparently my point, though valid, is moot since they seemed to have worked things out.

Sir, you got the cr1 visa already. I will make it to USA with or without her concern. When you reach here change the address on USCIS website and put an address where your greencard will be mailed to. Atleast that's what I will do if I am in this situation.

Thankfully they settled, he wouldn't need to change anything. Love conquers all!

Firstly, if her reason is that "You're coming to the US too soon" after you guys have waited for 3 years (as claimed by you),  then she's probably with someone else over there!  You need a good lawyer. Also, I'd advise you to travel to the US as sooner as possible before she blocks the move. If the fault is indeed from her and with the amount of time you've waited, then you traveling to the US should not be regarded as "an advantage" as seen from some other comments here.

Oh no! Sorry to hear that! You can still travel since you have your visa on hand.

When I lived on Guam, a 79 year old guy got a K-1 for a 19 year old Filipina.  She came to Guam, but they had a hard time finding someone who would officiate the marriage.  Finally found someone, got married, still together as far as I know unless he passed away....
