How long to wait before applying for AOS

Hello Folks,

 

We got married outside the US on January 2022. This was during the same time I was waiting for an L1-B interview appointment.

I got the L1B approved after the marriage and I came to the US on L1-B visa on May 2022. We were thinking of doing the AOS,

but in some forums, people have suggested to wait at least 6 months before applying for AOS. Is that so? What do you think is a good

time to wait before applying for AOS? (My L1B visa is valid until 2025)

 

 

Also, is it better to apply for the I-765  and I-131 along with the I-485? I am not planning to change my job for the next 2 years, if that is the

case, would it be better to skip these two? Because my L1 already gives me work permit and I am allowed to leave/re-enter the US in the meantime.

Timeline

You could have filed for AOS the next day after entering US. Go for it.

 

File for i765 and AP for free but don't use them. Applying for those doesn't impact your L1 status. They will be for backup in case your L1 goes south due to job loss. 

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

L1 is a dual intent visa, so there is nothing illegal nor suspicious with filing AOS on the day you arrive in the US.  No benefit to waiting to file.
