Dear all,

I am a bit confused after the NVC send me a review note again.  I submitted my husband ‘s mother as a household member(I-864A) of my case on 5 May 2022.  However, the NVC sent back a review note said his MIL needs to fill in as a joint sponsor(I-864) on 8 Jul 2022.  And the NVC deleted his MIL as I-864A document from my case.

We know that his MIL cannot be my joint sponsor as her incomes is not fulfilling the requirements so we upload a letter to NVC she will be withdraw her joint sponsor or household member and just use our current assets to continue my application on 15 Jul 2022.

On 20 Sep 2022, NVC sent us back the review note again…The msg as below,

1st review note

His MIL Form I-864A is missing. Please add H H H <edited name> as a Household Member in CEAC and upload all documents under their name. Please visit https://www.uscis.gov/i-864a to complete this form. FINANCIAL SPONSORSHIP RESPONSIBILITIES: Financial sponsors, joint sponsors, and applicants should be aware of responsibilities when signing an I-864 and the consequences for a sponsored immigrant's acceptance of federal means-tested public benefits. For more information visit https://nvc.state.gov/aos.

2nd review note which the NVC told us his MIL is not qualified to be a household member.  She needs to be a joint sponsor…Now NVC told me to add his MIL as a household member again…

Please disregard the previous message requesting H H H <edited name>'s I-864 sent on 08-JUL-2022.

NVC request to submit I-864A with his MIL again which I submitted in May 2022.  And they just request us to submit again.

Remarks: My husband and I live in Hong Kong and his MIL live in US now.  That’s why we can just only use our current assets to do this application.

Should I follow the review note from NVC that to submit his MIL in household member in form I-864A or what should I submit that my case will accepted by NVC as we need to wait for 10 weeks for another review.

The posters above have already addressed your questions.  To reiterate -- if your MIL's current income is below the minimum requirement, then she does not qualify to be a joint sponsor.  And since she and your husband live in different countries, she does not qualify to be a household member either.  If she neither qualifies as a joint sponsor nor a household member, then there is no point uploading her financial documents into CEAC.  You were already advised to remove her name from CEAC.

Hello, I’ve received the review note from NVC which is

This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p.

For this review note, I cannot add the AOS as I will use my husband and my current assets for this application.  Is that my case already send to the US Consulate from my living place?
I just need to wait for US Consulate in my place to reply?

And I’ve been received with these two review note at the same time but I cannot provide those of them as my husband do not work in US.  Should I ignore those msg or I need to reply something to NVC?

Please submit ‘husband’ Evidence of Income. For more information, visit https://nvc.state.gov/fin.

Please submit every 2021 W-2/1099 form for ‘husband’

Thank you

Cammy

Did you receive a CEAC message and NVC email stating that your case is "Documentarily Qualified" (DQ)?  If not, you must submit financial documents showing that your sponsor meets the minimum income/asset requirement.

No, I haven’t received DQ email.  Is it will send at the same time with the notes?

For the financial documents, as my husband is not working in US, he won’t have both documents.

For the current assets part, I have been written on the I-864 form.  Is there any other form I need to submit about the current assets?

Thanks

Cammy
