Spouse green card granted but political asylum pending

Hi there,

 

I’m from Colombia and 6 years ago my parents and I came to the US and applied for political asylum (I was 19) got married with a US citizen and was granted the 2 years green card. However, I resigned my political asylum (which my dad is the main person in that case) and I am going to Colombia in 3 weeks with my husband, but my lawyer just told me that it might be risky to go since on the way back to the US immigration can deny entrance if they want to because even if I resigned my political asylum it will stay in my immigration history until I become a citizen.

However, I resigned my political asylum (which my dad is the main person in that case) and I am going to Colombia in 3 weeks with my husband. Since it is safe for us to go, can I go?

if i were you i wont take the chance since it still processing ( not terminate yet )

even when u have termination letter, u might subject to scrutiny by CBP...hope u are aware with the risk

i agree with ur lawyer. there's always a chance

No, they are the main applicants and they are here in the US with me, but their political asylum is still pending. I got married and received a spouse permanent residency green card, since it is safe now for me and I am not longer in need for a immigration status I’m withdrawing my political asylum

If the threat to you and your parents is now gone, and you can travel back to your home country, would that damage your parents' case?  Why would they stay here looking for asylum if they can return home, and you are able to successfully vacation there.  I'm not sure their case can proceed based on what you've said.

They lawyer said no since I’m not the person that applied for the political asylum. I was 19 and my parents applied for it not me, so the lawyer said that if my parents were the ones traveling then that would affect the case.

Was this group just threatening your parents or others too? There's a reason behind this question. 

 

And you think they're gonna be happy to see you back? 

 

Asylum is one tough area. Once GC/ N400 is granted, the US government doesn't expect you to go back there because you ran away for a reason. I know Kenyans who lied and got asylum and are now USC. One thought he was so clever and went into Kenya via Uganda. So, he landed in Uganda and crossed the border via bus. He enjoyed his stay visiting those relatives that he's missed all this while. Upon returning to US, he was stopped by CBP who were waiting for him. They asked where he was and that was when he found out that they knew he was in Kenya. I don't know how it ended as I never heard from him again. The guy though he was being a genius by flying to Kenya via a neighboring country. USCIS/ CBP knows all these tricks. They're not new.

 

A lot of Kenyans are coming to US on B-2 and as soon as they get to the carousel, apply for asylum as they had the application ready. They then lie that there is a war in Kenya. You may be granted asylum, but expect scrutiny when you finally miss those relatives and want to go back home. A month or so ago, there was one here who wanted to use "genocide in Kenya." I laughed so hard and asked him for proof. People are crazy and shortsighted. I'm sure US embassy Nairobi or even USCIS would have had a field day with this one.

19 year old is considered an adult...just FYI..

Adulthood is at 18

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
