Bodega worker in Rikers on murder charge after stabbing attacker in self-defense

A hard-working Manhattan bodega clerk who was forced to grab a knife to fend off a violent ex-con, now finds himself sitting behind bars at the notorious Rikers Island jail charged with murder and unable to post $250,000 bail.

 

The sky-high bail for Jose Alba — who has no known criminal history — was just half of what controversial Manhattan District Attorney Alvin Bragg’s office demanded, despite surveillance video showing the clerk being assaulted by his alleged victim in the bodega.

 

During the fight, Simon’s girlfriend allegedly stabbed the worker in the shoulder with a knife she had in her purse, according to Alba’s defense attorney — but she is not facing charges.

 

Bragg’s office, however, charged Alba, a dad of three who moved to the US from the Dominican Republic 30 years ago searching for a better life, with second-degree murder. He became a US citizen 14 years ago.

Once you’ve looked up the apparent race / ethnicity of the jailed, the “victim”, and prosecutor, it will be apparently why Alba is in jail.  
 

This is a toughie  for AOC to sort out.

Simon — who was on parole and had at least eight prior busts, including for assault, according to sources and records — then shoved him into a shelf, the video shows.

 

The deadly confrontation Friday night came after an argument Alba had with Simon’s girlfriend, whose EBT debit card was declined at the store, where she attempted to use it to purchase potato chips for her 10-year-old daughter, police and law enforcement sources previously told The Post.

“It was either him or the guy at the moment,” said Alba’s daughter.

The 32-year-old woman said Alba snatched the snack out of her daughter’s hand, so she knocked over items on the counter and hurried home to get Simon, who stormed into the bodega and attacked Alba roughly 10 minutes later.

During the fight, Simon’s girlfriend allegedly stabbed the Dominican-born immigrant in the shoulder with a knife she kept in her purse, according to Alba’s defense attorney, but she is not facing charges.

 

Hmmm, difficult to come to any other conclusion.

He should be declared a hero regardless of the state.  Apparently the DA in NY is sending a message to immigrants from the DR.

He was not a monster.

The avenging boyfriend stabbed to death by a store worker he confronted in a Harlem bodega was a loving father who put his family first, relatives said Friday.

 

Austin Simon didn’t go into the Blue Moon bodega looking for trouble, his family asserted. Simon, 34, and the worker, Jose Alba, could have resolved their dispute without any bloodshed.

 

“He’s not the monster that they’re trying to make him seem like,” said Simon’s ex-wife, Tiana, 32, who did not want her last named used to protect herself from the public outcry over the case. “Everyone is judging him on a clip of video.”

 

Tiana said she and her ex had grown up together and had known each other since they were children. She said their split was simply the result of drifting apart — and that Simon cared about each of his nine children.

“Honestly, he was a great person,” she said. “When he loves people he loves hard.”

 

Simon’s cousin, Candra Simon, lays the blame for the fight at the feet of Simon’s girlfriend.

“What happened to my cousin and Alba started with her,” the cousin charged. “After not being able to pay for whatever with her card, she went and got my cousin involved.”

Relatives said Simon had a rough upbringing, but overcame it to be a devoted father and family man.

“He had a past,” Candra Simon said. “Everyone has a past. That does not mean he deserved to die like that.”

She also noted there’ve been tensions between Dominican and Black communities in the neighborhood that played a part in the conflict as well.

“No one will talk about the tension between the Black and Brown community in Harlem, how deli owners at times disrespect the men and women who grew up in those communities,” she said.

“He was wrong for going behind the counter,” Candra Simon added. “Alba was wrong for treating the girl disrespectfully.”

Jose's son started a GoFundMe for his father to pay for the upcoming lawyer costs.  But GFM cancelled the bid to raise money.  (I saw this last year with GFM, and again with the Canadian truckers ordeal, and will NEVER donate a dollar via them again.)

So they started another one:  

I not only donated $100 to Jose, I gave an extra $5 to GSG.  

Please give if you can afford to, to help overcome the injustice of this man's plight.

And the GoFundMe for Jose Alba was closed down because it violated their terms???

But his son set up a GSG account.  I donated $100 when it first began.  Glad the guy got off without having to go to court.  (Though I am not sure why they are still accepting donations?)
