Is this a legitimate reason to expedite?

According to what I've read, delays by the NVC are a legitimate reason to expedite. 

My marriage certificate was rejected through no fault of our own. We have fallen into a loophole. We are 2 foreigners married in Korea before a 2008 law created the document the NVC is expecting, a document we cannot get. 

I have written a letter explaining all of this and resubmitted with evidence. I've also reached out to my congresswoman who is supposedly going to help me. 

But...unless something changes, we have to wait 2.5 more months for NVC to look at our papers, i.e., we've been delayed b/c the NVC has no condition in their "logic" for cases like mine: 2 non-Koreans married in Korea before 2008 who CANNOT get the document on the reciprocity schedule. 

What do you think? 

I'm also considering submitting a supervisory review through the asknvc email address, but not sure if that will conflict with the potential help from my congresswoman or the potential nvc expedite request.

Can I expedite my case at the National Visa Center? Hi, I’m Jim Hacking, immigration lawyer practicing law throughout the United States out of our office here in St. Louis, Missouri. A lot of people are seeing a lot of delays of their immigration cases, and they believe that if they send in an expedite request, that is to try to get their case moving along faster that the National Visa Center, or even USCIS or the embassy will make their case go faster.

In my experience, requests to expedite unless they are the most dire of circumstances, somebody is literally dying, request for expediting are almost always denied. Or in other words, they just go off into the ether and no one ever rules on it, nothing ever happens on the case. So filing a motion to expedite is something that you can do. You can request that the embassy move faster, or the National Visa Center move faster or USCIS move faster.

And in the vast majority of cases, this doesn’t work. Now, I’m sure there’ll be people who will comment down below that say that that does work. And I’m not saying don’t do it. I’m just saying, don’t get your hopes up. Really, the only thing that works is suing them. And threatening to sue them, that doesn’t work, having a Senator or a Congress woman email them or contact them that doesn’t work, getting the ombudsman involved or emailing them every day. None of those things work.

 

But u can try / nothing to loose

So no harm in trying, but nothing to get my hopes up either.

Also is possible or a good idea to request a supervisory review and an expedite in the same submission to the expedite email?

From the description you have posted, it sounds like you are doing everything you can do.  When the document you have does not match the official reciprocity schedule, it will cause delays in your case, that's just the reality of the situation.  Hopefully the letter and additional evidence/explanation you have already sent will move your case along eventually.  NVC can be a very frustrating phase of the immigration process, because it seems like an unnecessary step for applicants and takes too long, even for straightforward cases.  It's all part of the inefficient bureaucracy of big government and a huge number of cases to review and  process.  Good luck!

My husband's case was expedited through the NVC in 2012 because for some reason (that we never found out) it got stuck there for longer than it should have. I contacted the immigration liaison at my U.S. Senator's office, he sent me a from to fill out via email (I have no idea what the name of the form was) and he contacted the NVC on our behalf. Within 4 days the case was at the consulate. But this was more than 10 years ago and A LOT has changed in the world of immigration since.

Nvc seems to be notorious for throwing back in the que. They say they have no supervisory review in place and one review line. I tried getting this done myself three different times but was told they don’t have a practice in place to expedite at nvc level

Thanks for that. 

Looking at your timeline I see that you got expedited. If it's not too much to ask what was your reason for that?
