Eligibility for Advanced Parole- Form I-131

Hello forum members, 

 

I think this is the right section of the forums to ask this question.  I am filing for AOS form I-485 for my wife based on marriage, and am now working through the I-131 form to file concurrently.

 

In the instructions on page 4, where it says "Advanced Parole for Individuals who are currently living in the US."

 

"a. If you are in the United States and seek an Advance Parole Document, you may apply if:"

"(1)  You have a pending application to adjust status, Form I-485, and you seek to travel abroad temporarily
for “urgent humanitarian reasons” or in furtherance of a “significant public benefit,” which may include a
personal or family emergency or bona fide business reasons."

 

I had the impression that the ability to travel on AP was broader than just "urgent humanitarian reasons" or "significant public benefit."

 

I've also read several times now that one should not answer Part 4 on the form "Information on your proposed travel."  Is that correct?  It seems strange as it seems like an easy question to answer.  How should we answer Part 4?

It depends on what basis you are applying, most people on this site are not subject to that restriction.

Hi, thank you, I am filing 130, 485 and 131 concurrently, AOS based on marriage/ for spouse.

 

I have now seen multiple advice for Part 4 "Information on your proposed travel" both on this forum and elsewhere.

 

I've seen advice to:

-leave it blank (not needed as you are not DACA applicant)

-say something normal like going to visit family

-Say "to be determined" or "unknown".

 

For Part 3, "Processing information", I've also seen advice to just put a date about 6 months from filing date, while others advise to print out the form and hand-write "unknown".

 

Does anyone else have suggestions on these two (Part 3 and 4)?

I think I made something up, but I had not fully read the form and did not know then it was not needed.

Thanks, the consensus seems to be that non-DACA applicants don't need to complete Part 4.  But on the sample form on the Visa Journey site, it is actually filled out, saying that they are going to Australia.

 

Do you agree with handwriting "unknown" into Part 3?

 

Some older replies said that AP is routinely approved for AOS applicants.

It is the Notes, unclear as usual, but on Page 10 it tells you what to submit in the way of evidence but there is an or which then triggers filing the I 485 which you are doing

You can put any of those you listed, it doesn't matter.
