Good people of visa journey , am filing for my spouse, 2 step kids and our own child, how many times do I have to fill the I-130 forms.(am filling the online one). What documents should I upload for my step children

On another thing we recently got married and there was a question how long we have lived together, do I need to put only the time after we got married or include the time before married?

What are the ages of each child?

Possibly an I-130 for each child and an I-130 for your spouse.

This assumes your biological child is not a U.S. citizen

Are you a U.S. citizen?

Thank you for the information.Yes I am a US citizen and my biological child is not.

How old is each child? That’s a critical question you didn’t answer.

Were you born in the US?

I am a citizen by naturalization and they are 8, 6 and 3 years

You file I-130 for each child.

When it gets to the visa processing stage you will file

* I-864 for the step children.

* I-864W for biological child, because the biological  child will be a USA citizen upon entry to the USA assuming the child will be living with you.

You will pay the green card fee for the step children. You will not pay the green card fee for the biological child.

When the biological child enters the USA, as soon as you have princes of official mail from a local, state, of federal government agency addressed to the child at your address, and official mail addressed to you at your address you use this evidence to file for a passport and passport card for your vilification child. Once you have the passport and passport card then file N-600.

1. Will you be adopting the step children?

2. Will your  spouse file for US citizenship when eligible?

3. Were you naturalized before your biological child was born?

4. I notice this thread.  What happened with the CRBA?

Thank you for the information, yes I plan to adopt the two step children when they arrive in the US.
My spouse will also file for US citizenship when she becomes eligible

Yes I was naturalized before she was born. I have applied the CRBA but was denied because I haven’t lived continuously for 5 years in the US

After the action is complete, you will be able to file for their US passports / N-600.

Alternatively once she becomes a  citizen, she can file for their passports / N-600s provided she becomes a citizen before they reach age 18.

How did you naturalize without living in the USA for 5 continuous years?

The standard for passing US citizenship to your daughter is 5 years (call it 5 * 366 = 1,830 days) of physical presence in the USA before she was born.

1. Were you in the USA on a non immigrant status before you got your green card?

2. If so how any years?

3. How many years did you have your green card?

4. what percentage of the  time  as a green card holder  were you in the USA?

For me I have lived and that’s what they said that my physical presence in the US is not up to 5 years since I use to travel out of US often

Ok I see other post on the CRBA denial.

I would have shown the I-94 travel record that proved I was in the USA for 5 years because based on what you posted in your other topic you have the 5 years.

My fear is USCIS will deny her I-130 because USCIS will look at your CBP travel records and say she is a citizen.

I used to visit and later moved permanently on Dec 2014.

So you’ve been in the USA prior to December 2014? How many days?

How do I get the I-94 travel records?

You can also do a FOIA search.

It’s pity you didn’t continue with the topic you posted last year as I am sure the folks contributing would have helped you document the 5 years.
