Hello,

We are in change of status right now, My wife just got her work permit, For tax purposes , can I add her as my wife on the 1040 EZ form even though she has not received her SS card?

I wanted to see if I can check on that box "Married" but was unsure if I can only do it if I have Social Security Card.

Given that its not remotely even tax season right now, I'm not sure what you are asking? For what year are you filing 1040EZ, if its 2006 (i.e. you're filing late) then you can only file as married if you were married in 2006.

Yes you need to fill out a W-7 http://www.irs.gov/pub/irs-pdf/fw7.pdf and attach it to your 1040.

Can you fill in your timeline? You would need to be married in 2006 to be able to file as married.

The short answer is yes if you were married on/by January 01 (for 2007 taxes), or on/by December 31 (for 2006 taxes)- although I'm no tax expert. :thumbs:

Eh? You don't need to be married on January 1st to claim as married for 2007 taxes.

Ok, yes for 2006 tax year, I got an extention. We were married in 2006. My question is under form 1040 Can I check Married box"Even if only one had income) without a social security card?

To file as married for tax year 2006 you would need to be married on Dec 31st 2006.... to file as married on your 2007 tax return you will need to be married on Dec 31st 2007..... if your wife does not have a SSN and one is not available to her then you will need to file for an ITIN.... this can be done on form W7... IRS website has this form or you can get it from your tax pro/accountant....

Eh...I guess I should have expanded the explanation - if you're married on or after January 1st - you can file as married for that tax year - of you're married by December 31st (say 12/31/06 you can file for 2006 - and of course for every year after). but thanks for pointing that out..:blush:

Yes of course you can... but you do need a tax ID # (ITIN) in lieu of SSN

OK, I assumed that's what you meant. "On/by" does not mean the same as "on/after". ;)

If you were married in 2006, you are required to file as "married filing jointly" or "married filing separately" but you must file as married. After you are married, you cannot file as single. If your spouse was a US residence for tax purposes for 2006, and you don't file jointly, then she must file separately as well. If you won't have her SSN in time, get an ITIN for her by attaching a W7 to your 1040 and mailing 1040 and all attachments to the Austin, Texas ITIN operations center.

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

However. since she has her work card she is eligible for a SSN, and therefor INeligible for an ITIN (you are only allowed to get an ITIN if you are unable to get a SSN)
