Form I-751 Current Edition

Hello,

 

My wife and I are preparing to begin the filing for removing the conditions on her green card. Her card issue date was October 20, 2020 with an expiration date of October 20, 2022. It is my understanding that we should have the packet send off as soon as possible after July 20, 2022 at the start of the "90 day window." 

 

We are following this guide: 

 

 

I am wanting to verify that we have the current form, as the form we have downloaded and the one appearing on USCIS's website says "EXPIRES 12/31/2019" so I'm a little worried. I don't want to make the mistake of sending a non-current edition of the form and it being rejected and losing the $680 filing fee.

 

Any help would be much appreciated! Thank you.

That’s the correct form

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Just a little confused is all.

It is an internal government date / marker.. OMB Office of Management and Budget. If it is the form that is available on the USCIS forms tab, then it is the current form, even if it is past the OMB expiry date

USCIS must not receive the package before 7/22/2022, which 90 days prior to the expiration of her green card.  I would not mail the I-751 package until that date.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As others have posted, don't try to hit the exact date to file early, always ends up poorly it seems like. wait a week after your eligibility date to file. they are taking 2-3 years if not longer to even look at I-751's, an extra week isn't going to matter, you will be filing the N400 for citizenship before they see your I-751 more than likely.

You can safely mail it 90 days before the card expires if it is going to Phoenix and 89 days before the card expires if it is going to Elgin (suburban Chicago).  Time travel isn’t a thing with USPS except when mailing from the western pacific rim.  Lots of non stop flights from the pacific rim to O’Hare.  Sky Harbor: not so much.  
 

Among the October 2021 I-751 filers none of us who mailed on day 90 or 89 had any problems.

We filed ours in February of this year. We checked until the night before whether the edition date changed. You might want to do that

July and August are 31 day months.

Whatever form is available on USCIS website the day you send your petition, is always the right form. 

 

You can also check on the i-751 page on uscis.gov under the tab "Edition Date". It clearly says:

 

Edition Date
 

12/02/19. We will publish a new version of this form soon. In the meantime, you may continue using the 12/02/19 edition despite the expiration date. You can find the edition date at the bottom of the page on the form and instructions.

Dates are listed in mm/dd/yy format.

K-1: 12-22-2015 - 09-07-2016

AP: 12-20-2016 - 04-07-2017

EAD: 01-18-2017 - 05-30-2017

AOS: 12-20-2016 - 07-26-2017

ROC: 04-22-2019 - 04-22-2020
Naturalization: 05-01-2020 - 03-16-2021

U.S. passport: 03-30-2021 - 05-08-2021

As what was pointed out to you, check the USCIS website right before you send off your packet to make sure the form did not update on you. These forms can change on a dime!!!!


4 years, 11 months, 2 weeks and 3 days

Citizenship Complete!
