my complicated situation / overseas travelling

I believe Im in a really complicated situation right now and I honestly don't know what to do.

 

BACKGROUND:

 

I was married to a US citizen and we decided to get divorced few months before my 2 year green card expired. Bona fide marriage, just did not work out.

I was working full time and also going to college during the divorce and decided to apply for removal of conditions with the Divorce waiver. My ex even helped me with paperwork, but it was a Divorce waiver application.

I was starting to get my life together in the US, specially after a divorce that broke my heart, but I had goals, I really want to become a Nurse and I was loving going to school and loving my job.

 

I have been waiting for USCIS answer for almost 2 years ( my 24-month extension letter  expires in 30 days ) , and yet, no answer from USCIS, no RFE's. They never sent me anything. Last time I contacted them they said my I-751 is in the normal processing time. ( Potomac office )

 

OK, NOW WHEN MY STORY GETS COMPLICATED:

 

A lot of different things happened with my family, overseas:

 

My father was diagnosed with cancer in 2020, but his medical condition started to get worse in 2021. my father was always scared of being sick and when they discovered that he had prostate cancer, the cancer had already spreads to his  bones and others parts.  Nine ( almost 10 ) months ago, I found out "by accident" that my grandfather was really ill ( my family likes to hide stuff from me coz I live overseas, etc ).

So I explained the situation in my job/ college and took a flight to see my grandfather. He was dealing with alzheimer for many years ( he was 93yo ) and 1 week after I get there, he passed away. That was really sad, and seeing my grandmother ( that is 90 ), now having to live by herself was just heartbreaking....and yet, my grandmother had a stroke just 2 days after my grandfather passed away.

I decided to stay a little bit longer. 

within a few days my mother told me everything about my father medical condition, and I dont know how to explain in details but the things started to get really complicated for him and I started to get really scary. My father was really weak this last two semesters and dealing with deep depression. 

A couple months ago he finally had a surgery to remove his prostate, but after that he has been dealing with high fever and urinary infection almost every two weeks. 

I have been helping to take care of my grandmother ( who is 90 yo ) and my father who is 65. My mother just could not do all byherself coz she is the only one working.

Its been almost 10 months that Im outside of the US, I could not leave my family with all this drama going on here.

 

 

If I was already a US citizen, I would just stay here now until the things get better, but that's not the case. Im a LPR with a pending i-751.

 

I booked a flight to the US and I ll be flying in 1 week, I dont know what to expect. My 24 months extension letter expires in 30 days. 

- I dont know if I already lost my green card,

- If im gonna get in trouble.

- Im sick to my stomach to have to leave my family now, Do I have any option to stay overseas longer?

- I know my case is a "waiver" divorce. Do I still have any change to get this 10 year Green Card approved?

- I want to live and work in the US for good, it just really complicated for me right now. I live with my fiance in the US. I did file my 2020/2021 taxes

Sorry to hear about the issues with your family.  Being outside the US for 10 months is fairly long, but it is less than 12 months, so you should be fine if you come back soon.  You still have a valid extension letter and I assume your expired GC, and you may face a few questions when re-entering, but it sounds like you have your reasons.

If you have a valid extension letter and your expired Green Card, you will, likely, have no issues returning to the US.  Once your extension letter expires, you will need to get an ADIT stamp in your passport for future travel while your I-751 is pending.  Good luck in your journey.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Shouldn't affect the I751 process unless you missed an interview while you were away (hopefully you were still getting your mail through someone else).  It could impact an eventual N400 application relative to continuous residence requirements.

I keep track of all my mail.Im just worried if they can deny my case based on the fact that Im all this time overseas,

Also I was thinking about apply for a reentry permit ASAP in case I need to travel again (?) or do you think a reentry permit at this point not going to help me?

If you think you need to go back for another extended stay, a re-entry permit is not a bad idea.  Just make sure you get an ADIT/I551 stamp first since your extension letter is going to expire soon.

It should have no bearing on your removal of conditions. Once again Refuse to sign I-407 if cajoled at the port of entry.
