Document checklist for I-485, I-864 and I-131

Good morning everyone,

 

I am, USC, filing for the Green card for my dad today-tomorrow who is in USA on F2 visa. I have already submitted I-130 online and will send I-485, I-864 and I-131 in mail. I do not qualify to sponsor him so his friend will do it. He also applied for TPS based on situation in Ukraine and for work authorization along with it.

I would highly appreciate if you could take a look at my checklist of documents and let me know if I am missing anything.

Form I-485

  1. Cover letter of the contents for I-485.
  2. Personal check $1,225.00
  3. 2 Passport style photographs with full name on back and name on plastic bag
  4. Form G-1145, E-Notification Application.
  5. Government-Issued Identity Document with Photograph.
    1. Photocopy of passport's biographical page with picture
  6. Birth Certificate with certified translation (original or copy is enough?)
  7. Inspection and Admission or Inspection and Parole. Submit photocopies of (all):
    1. Passport page with admission or parole stamp
    2. Passport page with nonimmigrant visa
    3. Form I-94
  8. Documentation of Your Immigrant Category.
    1. Receipt of I-130 application notice
  9. Evidence of Continuously Maintaining a Lawful Status Since Arrival in the United States
    1. I-20s (all 5 of them)
    2. I-94
  10. Affidavit of Support. (Form I-864)
  11. Report of Medical Examination and Vaccination Record (Form I-693)

 

Form I-864

  1. Cover letter of the contents for I-864.
  2. Form I-864, Affidavit of Support
  3. Green card copy of the sponsor
  4. Tax return transcript 2019, 2020, 2021
  5. 2021 tax return forms 
  6. 2021 W-2
  7. 2022 paystubs (01,02,03,04,05)

 

Form I-131

  1. Cover letter of the contents for I-131
  2. beneficiary’s 2 Passport photos with full name on back and name on plastic bag
  3. Form G-1145, E-Notification Application.
  4. Form I-131, Application for Travel Document.
  5. Copy of beneficiary’s passport biographical page.
  6. A copy of beneficiary’s visa and most recent admission stamp Page.
  7. A copy of beneficiary’s I-94 Form.
  8. A copy of any document issued to you by USCIS showing your present status, if any, in the United States;
  9. An explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole Document; or

Submit an I-765 based on this I-485 as well.  Filing is free anyway, if sent concurrently or after the I-485.

 

If you are the I-130 petitioner, then you will always be your father's primary financial sponsor.  You must sign and submit an I-864.  Your father's friend can sign and submit another I-864 as joint sponsor.

@Chancy he submitted 765 along with TPS and paid for it already unfortunately. So, didn't see sense in sending the dorm again. 

 

I am i130 petitioner for him. Do I really need to submit I-864 for him as well? Just doesn't make sense. Even if I don't qualify? Can you please elaborate here more? I don't think I saw it anywhere in instructions.

You are the petitioner, and the sponsor, full stop.  He may need a joint sponsor, but you are always the primary sponsor.

I filled up my I-864, would you take a look at the list that I am submitting? My main concern is that sometimes submitting W2 along with transcripts (like I did for joint sponsor) may delay the case, won't it?

 

@Rocio0010 , in the post I linked below you mentioned that if I submit W2 and transcripts together then my case will be delayed. I'm submitting Federal Tax Return and not transcript with my W2 is that fine? My joint sponsor also submits transcripts for all three years + W2 for 2021. Should I include all these?

Yes, it should be fine. I said that because if you send them W2s and whatnot it is more paperwork for the officer to understand, vs if you just send them the IRS transcript. No, I don’t have evidence that it does happen, but knowing USCIS, it most certainly delays the process 

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
