What is my legal status while I-485 is pending?

If you have filed Form I-485, Application to Adjust Status, you generally are not confined by the restrictions on your non-immigrant visa. You have the right to remain in the United States while the application is pending.

when you get the green card
U.S. permanent residents have the right to be protected by all laws of the United States, the state of residence and local jurisdictions, and can travel freely throughout the U.S. A permanent resident can own property in the U.S., attend public school, apply for a driver's license, and if eligible, receive Social .

I've told him that , but he won't say anything to upset her because her husband past away 2 years ago and she had to move in with us, she uses that as a weapon against my husband, crying and making herself the victim when he confronts her and tells her to stop her #######. I have ignored it for as long as I can I don't speak to her unless I absolutely have to ,she told me I only married him for a green card and this is how she treats me in MY own house.

I hate to say it but you and your husband need to have a very serious conversation about your future because right now it sounds like there are three people in the marriage. Whether it's jealousy, narcissism or what, your MIL is trying (and succeeding if husband won't stand up to her) to drive a wedge between you and your husband.

You didn't ask for relationship advice but I strongly suggest you talk to your husband about getting mother in law settled into her own place. It's been two years since her spouse died? That should be plenty of time for her to 'get over' needing the immediate emotional support a close family member provides - if not, then support her seeing a therapist and encourage her to move out anyway. She should not be in your home making you feel unwelcome. Her behavior is not befitting a guest, so it's time to show her out.

If your husband refuses to take any action whatsoever then I highly recommend you undertake couples therapy and that he does some individual therapy to sort out his issues with his mother (sounds like she might be an overbearing sort and he's learnt to just let her have her way?). Otherwise, despite whatever best intentions he may have had when you got married, your relationship will be in jeopardy long term.

So I have a really nasty mother in law who lives with my husband and I , who keeps referring to me as "the illegal" my husband and I filled my AOS and we have the receipts. Ive tried to explain to her that I have authorizated staff while our case is being adjudicated but she keeps saying stuff like she could go to prison for harbouring an illegal. Can someone please give me the right explanation so I can explain to her ? Thank you

Yes, you are authorized to stay. While receipts do not grant you any immigration benefit currently you are also not in violation of any immigration law.

Talk to your husband maybe? Sounds like a weird spot to be in. Consider moving away with your husband?

U are authorized to stay while the case is pending.

about ur mother in law, that u need to have conversation with ur husband. I used to live with my ex bf and his mother, even though she’s not mean like urs, it’s definitely rock the boat.

there’s a reason I’m not with him anymore since he can’t be separate with his mother. ( food always ready, house is clean etc, clothes all washed  ) LOL

This is clearly not about your status at all, you guys have other underlaying issues. For that reason, I don't see what good it will do to try to "prove her wrong" on this particular issue as it won't change anything anyway.

Even once you get your greencard you will still have the same issues, only that the argument will shift from being illegal to something else.
