Hello Everyone,

I am an Indian citizen and my wife is a US citizen. We both are in the US right now. I am here on L1-B visa.

We were looking into doing the adjustment of status by ourselves without the help of a lawyer and came across a small issue.

My passport and birth certificate have different places of birth. Passport has the name of the hometown where as the birth certificate has the hospital where I was born as the place of birth.

Now, for filing the I-130 and I-485, is birth certificate mandatory for me? If so, is this mismatch an issue? If so, what should I do to get it fixed?

Thanks

Yes BC is mandatory for you, no exception.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

So the hospital is in a different town?

Not every hometown has a hospital to be born in. I could be born in a hospital in Boston and reside in Norwood which is my hometown. Easy to explain why they dont match. Not to worry.

Agree with others about your birth certificate’s city of birth being a non issue.

Does  your wife  have an original of at least one of:

* US birth certificate

* US CRBA

* US certificate of naturalization

* US certificate of citizenship

?
