Hey guys,

  my fiancé will be moving from his home country Greece to Germany.  He will stay there for 10 days and then fly out to meet me in the US.  He’ll stay with me close to 3 months but not exceeding the 90 day tourist visa.  Before he comes to visit me I will mail the I-129f application.  After his stay with me he will go back to Germany. Here’s the question: which embassy should I choose for the consular processing ?  In Greece or Germany.  Keep in mind my fiancé’s German is very basic.  He is a Greek citizen by birth.  Would it cause confusion or distrust or denial if I choose Germany?  Would it be better to have his German address as his mailing address and keep his Greek address as his physical address and chose the embassy in greece so as to not raise red flags?

Where does he actually live? That is where I would choose to interview, because it would clearly be the most convenient. And it's definitely not a red flag to interview in the country you live in.

Nothing wrong with a Germany mailing address along with a Greece physical address. But if the K1 beneficiary is living in Germany, I'd just just make the mailing address the same as the physical address in Germany. More importantly is that he has documentation to live in Germany legally.

 

For the K1 beneficiary interview, choose the consulate/embassy with the fastest processing times.

Nothing wrong with a Germany mailing address along with a Greece physical address. But if the K1 beneficiary is living in Germany, I'd just just make the  mailing address the same as the physical address in Germany. More importantly that he has documentation to live in Germany legally.

Yes of course 2 years dating .  Met in Greece, took a few trips together .. not an issue of relationship..

Whichever embassy you choose on the I-129F will not matter.  By default, the approved petition will be forwarded to the consulate that handles K1 cases for residents at the country listed in the beneficiary's physical address.  So if your fiance's physical address is in Germany, the case will be sent to Frankfurt, even if you selected the Athens consulate in the I-129F.

July 18, 2023 approval

How’s his English? His German doesn’t have to be good as long as he can interview in English at the embassy. It is an American embassy so that is always an option :) 
 

To the poster who asked about legality … if his home country is Greece he’s an EU citizen and can live anywhere in the EU. All he needs is an EU passport to prove legality, however, it’s possible the embassy would ask for proof he’s actually residing in Germany.

His English is minimal. Can he have someone with him to translate? A relative there or even myself?
