I-751 Removal of Condition: Request to Switch to Divorce Waiver - no reponse from service center

Hi everyone,

 

As the title described, I am in need of recommendations on what to do after I have submitted my request to switch to divorce waiver since my divorce got finalized last March. I sent the packet with all the pertinent papers to Nebraska service center last April 2022 and it was received on April 15. I waited for 6 weeks and I submitted a case inquiry on the USCIS website about "missing notice" (if that was the right one to submit). The case inquiry is still unassigned to this date.

 

I applied for the I-751 ROC last year March 2021 but I haven't heard anything back from the service center after the 24-month extension. I only sent the packet to the service center under the assumption that they won't forward I-751 cases to local field office anymore unless there is a need for an interview. I know it's a matter of waiting game at this point but if anyone has a relevant experience, can you share your experience and any insights about it? I read some relevant posts regarding the request to switch to divorce basis and it looks like they got an immediate response from the service center, but that's not the same on my case.

 

Prior to this request submission, I planned on hiring a lawyer but I couldn't afford it. I got some advice from some lawyers (free consults) and some research through this forum and it seemed really straightforward so I did it myself. I'm really hopeful that I did the process correctly. Hope someone can ease my anxiety about this case. Thanks for your responses.

Timeline

Keep records of everything you sent to USCIS including proof of mailing and delivery. 
 

Down the road, if USCIS claims you were approved without informing them your were divorced you will have evidence that says otherwise.

It seems to me that you did everything correctly. Seconding the advice of keeping a record of everything you sent (including the mail receipt confirmation) in case they give you grief saying that you didn’t inform them of your divorce prior to the interview.

I would wait another month, and if you don’t have any news, I’d call USCIS and request to talk to a tier 2 officer. Those are the ones that would be able to tell you if your divorce decree has been matched up with your case or not.

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

@Rocio0010. Do you know how to talk to a tier 2 officer? I want to be ready as soon as I can. 

 

In addition to my case, when I submitted my request to switch to divorce waiver, I submitted additional evidences (including the divorce decree) to save me and the IO time in sending RFEs. I was hoping that sending all those documents all at once would expedite their decision regarding my case but it doesn't look like it. I will be travelling out of the country this year as well so I'm hoping there won't be any problems about that.

Call USCIS. When you hear the prompts, say “info pass”. They will connect you to an agent (a tier 1). Tell them you need to connect to a tier 2, briefly explain the situation and wait for a call back (usually 30 days)
