What if my spouse came to USA with a diplomat visa after I made her the petition and waiting for approval? Can she stay with me and we remarried or No? what to do in this situation?

If she is your spouse, you do not remarry.  Have you started any process for her yet? If so, what is the current status?

Yes I already married her and she is already even pregnent . The status is pending and waiting for approval. I made the petition to her and send all the documents.

OK, so you are already married.  Married is married, so you are married everywhere in the world. (Unless Polygamy)  You continue the process.  When it's time for her visa interview, she flies back to Jakarta and gets her visa.  If the child is born in the USA, the child is a US Citizen already.

so if she come here in USA with diplomat visa , she can't stay with me directly and waiting the approval? or she need to go back where she came from and wait? Remember me I am in the USA already and living here.

Where she stays while she's here is up to her, and her diplomatic job.  If you live in California and her job is in Washington DC, it would hardly be practical for her to live with you full time.  This is a matter of logistics, not immigration.

Ok let to be clear, she is not really a diplomat but my oncle can get a diplomat visa for her , just to come here and be with me. that's why I'm asking if she's just coming here, can she stay with me? and what we have to say the USCIS? Can I tell them that the person I made the petition is already here?

I’m sure the US government would love to know that her country gives diplomatic visas for fraudulent purposes. Wait, maybe they do already.

No I didn't , just my oncle asked me if will work or no. That why I asked the question here.

You think if it’s that easy for your uncle to do the government here hasn’t figured it out already?
