Filling I-134 and 2021, 2020, and 2019 all fall below the income requirement. I just got rehired at my old job and I’m estimated to make $33k-$40k yearly. Any advice on using my current income and not the last three years? Household size of 3 I129F

Show your last 3-months payslips. Get an employment verification letter from your employer. If necessary, find a joint sponsor, who also has income above the 100% Federal Poverty guidelines, to complete a second I-134. Current income trumps previous incomes.

Remember the I-134 is for the consulate/embassy to show that you or your fiancee are not risks to be public charge or government assistance.

The "real" binding Affidavit of Support is the I-864 during the Adjustment of Status, which is the contract between the petitioner and the government for being financially liable while the beneficiary is in the US. The required minimum income for the I-864 is 125% of the Federal Poverty guidelines for the appropriate household size.

Good luck!

Is there a way to just use the letter of employment and paystubs? It’s awfully sad but I’m the highest earner in my family… so joint sponsorship is out of the question.

Remember that the I-134 is to convince the consulate/embassy, and every consulate/embassy may differ a little. So even if the joint sponsor(s) (can be more than 1) has/have earning(s) less than you but above the 100% poverty guidelines, the aggregate of I-134s might convince the consulate/embassy?

Again, current income trumps the previous income.
