Hi Everyone I need advise. It’s been 6months been in the US via an IR1 visa. My current state of residency don’t have the degree programme I plan to pursue. In other to do that I have to school in a different state for a 2-4year duration. My wife’s job doesn’t permit her to move with me for the duration, I would be the only one always coming back to my state of residence monthly to see my wife and I won’t have an income coming in since I would be schooling.  My question is if I decide to go that route what happens when I apply for Naturalization in 2years and some months? Is there anyway to navigate this?

You will have to explain the situation to the IO and the IO might or might not accept it.

Do not make the mistake of checking the “separated” box on your N-400.  You are not living together but that does not mean you are separated.

I thought you had to live together by the time one applies for naturalization

If you applying under the 3 year rule and are  in  a valid state of matrimony, you are not required to be in the physical presence of each other 24 hours a day each day.  Or even one second per day, each day.

Can you pls expanciate more on this. Since I entered as IR1 and still married. I only need to go to school full time for 2-4 years in a different state. Which I plan to at least come home 1-2 times monthly. Will that endanger my naturalization approval?

When I had a green card, I went on business trips. I wasn’t required to take my usa citizen wife with me.

With my second marriage, I’ve gone on business trips. I’m not required to make my LPR wife with me.  My LPR wife has even gone on personal trips without me. This is allowed.  There is no legal shackle in INA that requires an LPR married to a citizen to be together all the time.

Going to school is taking care of business.  It isn’t a separation.

The IO might or might not agree.  The onus is on the person applying for citizenship to make the case.
