do you have green card already? are you doing AOS or consular processing?

if your biological son is only 2 years, he should be american when he was born

did you already marry when you deliver the baby?

I already have a green card. Filing though consular processing. My husband can’t pass on the citizenship to our som because he hasn’t met the physical Stay requirements. We were married when he was born.

Your husband is the biological father and on the son's birth certificate, right? and he is a US citizen when child was born?  I thought that qualifies as CRBA?

However, once your son get his visa and touches down in the US he automatically becomes a US citizen if he will be residing with your husband.

He has to have lived in the US for 5 years before the age of 14 or have been in the us at the time of the child’s birth

Original copies of files you sent to NVC. Updated I-864 affidavit of support form for the latest tax year.

We weren’t required to file I-864 by NVC. We are exempt as he is the child of a US citizen

Original marriage certificate, original birth certificate, Passport, address in US - the least.  Am curious, what did you file in Consular processing if not CRBA? Is it I-130?

"You may be asked to provide supporting evidence with respect to your residential address. Examples of documents that can help demonstrate residence include, but are not limited to: property rental leases and payment receipts; deeds; utility bills; property tax records; automobile registrations; professional licenses; employment records or information; income tax records; stamped school transcripts; military records; income records, including W-2 salary forms; vaccination and medical records"

Find your consulate on this list and read the instructions for what to bring

Or is this N600K ?  https://www.uscis.gov/n-600k
Then take with you all the originals that you have submitted to USCIS.  Refer to link, then under "Checklist of Required Initial Evidence (for informational purposes only)"

I don't have any experience with your situation, but when I filed the CRBA for my child (female USC), I had to provide pictures of my pregnancy and pictures of my child growing up...even though I applied for it when she was about 3-4 months old. Have they mentioned taking progression photographs of the child for the interview?

If all fails, they’ll ask for DNA. Relax, it’s one of the easier petitions if there’s something as an easy immigration process.😁

Just another random guy from the internet with an opinion, although usually backed by data!
