Did not file i-131 with the AOS documents, is it too late to file now?

I am asking on behalf of my brother and his now wife. They just recently submitted their AOS documents along with evidence as requested. They did not do parole form i-131 because they didn't know how long the AOS will take and when she would be traveling again. I helped them fill the documents. But the question they have now is that can they still go ahead fill out the I-131 if she has only an idea that she wants to travel the end of the year or something for her sister's wedding in her home country? Is that possible or that document has to be filed with AOS? If they file now, will they have to pay the fees for i-131 or can they submit it as is without the fee? They just recently filed it so they have not even received the receipt notice for the AOS yet.

Timeline

An I-131 can be filed alone after a proper I-485 has been filed.  They should include a copy of the I-797 they received after filing the I-485. It will be free.   However, they should have a Plan B ready since Advance Parole could take up to 8 months.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you for that information. Do you know how long is it taking for the AOS to be currently approved and a conditional green card to come?

 

I guess I want to know when she can travel with current situation.

Depends on the local office.....could take a year or more.
