I started my K1 visa in 2006 with my Chinese wife arriving in 2007, in 2009 she went back to china to help care for her father, she had an accident receiving head trauma so in short she did not communicate at all with me for 3 or 4 years, I had to divorce here , she remarried had a daughter an is now divorced, her ex has custody being her living environment. I am now learning these things 13yrs later. she has a SScard still.  what do i need to do to bring her back? 

And My imagration process paper were lost in a fire

First thing, do you want to marry her? 

 

If yes, then marry, get all the divorce papers, and file for a spouse visa.  You will need to marry her in China, in a 3rd country, or online.

 

If not, then you can't "bring her back".

 

The old immigration paperwork has no relevance.

File a FOIA for each of you as the “ subject of record”, reason=record review, ask for complete A# file ..its free but will get you copies of the first  immigration journey .https://www.uscis.gov/records/request-records-through-the-freedom-of-information-act-or-privacy-act

 

Given the circumstances and reconnecting after a long stretch, you need to plan an in person visit ASAP and if it’s your decision to marry again and bring her in, you could schedule a Utah- online marriage ( while you are both in China, you will be getting married via zoom in UTAH! Marriage will be valid and “ consummated “ for immigration purposes. 

 

Have her gather the civil docs needed for her overseas marriage/ divorce , birth certificate for her and child and you could file the I-130 spousal visa.

Where is she right now?  China?  Since you are going to have to meet again before filing anything, I suggest a Utah online marriage, meet, then start the spousal visa process.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

How do I get an Utah marriage license? Living in South Dakota 

can you get married being apart?

As previously advised, you can get married whilst apart, but you'll still need to meet in person again before you can petition for your wife anyway. Just Google 'Utah online marriage'. Or you could travel to her, and get married in person, then file straight away.
