Hi! 

My fiancé and I have had our K-1 in process since December. We are now waiting for the interview process, but there are some nuances with our case. My fiancé is Ukrainian and has fled his country due to the war. We are now physically together (yay!), and have lived in Mexico for a few months and then now in Canada, as he has been approved for an 8 year visa with a work permit too. Our K-1 case was automatically moved to Germany due to the war, but we are asking for it out of Canada now. We are hoping this will work, as there can be some issues with this, but if not, we will request out of Mexico. 

My fiancé has just been (basically) approved now for Humanitarian Parole and we are hoping to enter to USA next month. My question is, I know if we were to get married on Humanitarian Parole, this would eliminate all of our work on the K-1, but it also seems silly if he will make it to USA, then have to leave for his interview and won’t be able to return until he gets the K-1 approval. We just wonder what getting married on Humanitarian Parole would entail to know all of our options.  


TL/DR - what will getting married on Humanitarian Parole do to legal status and ability to stay in USA?

K1 visa is to enter the US

 

If he enters on HP then it becomes irrelevant

 

Marry and adjust.

Once you both enter the US and marry. The K1 is dead (you cannot receive the K1 if you are already married).

If you enter on HP and get married file for adjustment (basically the same process you'd follow after marrying and entering on K1 except you will also file an I-130).
