How Soon After Cancelled Petition Can I Resubmit New Petition

Timeline

Make a long story short i had submitted a I129F and it got approved and was making its way towards the embassy. My relationship with that person ended so i sent a letter to the USCIS requesting to cancel petition due to relationship ending and it was confirmed canceled.

 

fast forward couple of months started a new relationship with someone i have actually known for years. Freindship has turned into a romantic relationship and this time i feel it can work and would like to submit a new I129F. 
 

My question is my previous petition was never denied, do i have to wait before submitting again or can i full send and resubmit a new petition for my new relationship?

Have you met this new one in person in the past two years?

 

If so, you can file a new petition.   Expect some scrutiny.

Yes i have multiple times already.

 

i figured they are going to give me a hassle…know what specifically to expect?

They will wonder if you are simply habitually filing for foreign fiancés, and may question the bonafides at the consular level.

Can I apply for another K-1 Visa? You can only apply for a K-1 fiancé visa one time in a 2-year period, and only two times total. So if it has been more than 2 years you are okay. If it has been less than 2 years you will need a waiver.

With all the delay that k1 are experiences, why dont you get married and apply for spouse visa?, spouse visa is less expendive and the beneficiary can work right after arrive to USA. Eith all the delay in uscis , spouse visa is best option

Aos interview July 2018

Work permit September2018

Aos approved July 24, 2019.

Roc April 27, 2021

Biometric reused june 28, 2021

N-400 online April 27, 2022 base on 3 years rule, biometric reused.

N-400 interview on December 12, 2022 combo interview i-751. Approved.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

January 13, 2023 apply for us passport.( regular service).

March 11, 2023 passport in hand

Just wanted to give you an update ended up submitting a new K1 visa for my new fiancee i know this is my second time filing so i anticipate questions about the previous one which im worried about just hope we can cruise to a successful approval i feel we have a numerous amount of positive evidence to prove its all legit.

Talked to a lawyer and apparently it switched back right now that k1s are coming through quicker than spouse visa.

 

we discussed if we got no goed here we will get married and go that route

Have you personally filed for mutliply K1's?  Did you get scrutiny?  

See multiple filer waivers for info.

Just went through it all with a magnifying glass.

 

I dont need a waiver because this my second filing (after second you need a waiver) and because it was after 2 years of original filing of the 1st one so im in the green fortunately.

Right.   And I did not say you in particular needed a waiver.  I have seen folks on VJ receive scrutiny as multiple filers, even if they do not require the waiver.  
 

Expecting and preparing for scrutiny is just one more way to be prepared.
