@Michael98 when were you last in the US?

How long were you in the US?

If the time between last exit and interview for student visa is less than the time you spent in the US expect to be denied.

It doesn't matter how much evidence you have.

J visa and student visas are non-immigrant visas. If it looks like you are trying to live in the US.... you will be denied.

Give it at at least 1 year before you try again.

I was there 4 months. Last edit was 4 month ago.

I just want to complete my masters degree there and therefore I need f1, that’s it.

The decision to issue or not issue you a visa lies solely with the embassy/consulate. The school can’t do any more than it has already done, that is, issue proof of your admittance and that you have  satisfied them you can pay for it. The school cannot guarantee that you will return home after your course, or mitigate a signed statement you gave to CBP before. Only you can (try to) fix those issues.

Yeah I know it’s still worth a shot. It they offer me to talk to a specific government official for me , I am not saying no.

Okay. I would try for the Spring semester of 2023 Or better  yet Fall semester of 2023. 2024 would be even better.

If this course is so important to you. Another year won't hurt... get some more work experience in Germany. It will only help you when you start the masters...

I find a lot of students really benefit from life experience when they move on to their graduate studies.

Students who move straight from bachelors are more "academic" in their thoughts...

ETA: This is life advice and US visa advice.

Thank you that helps a lot. So do you think instead of reapplying for this fall, only consider spring 2023/fall2023?

I‘ll see what the lawyer has to say abt this. His names is Michael Jackson so my hopes are up 😄😄

That is for those who experienced difficulties at the ports of entry or airports. It does not include consulates.

What would be your goal in doing so?  Overturning a CO's decision?   If so, you are still fighting a lost cause.

I see.......still trying to fight that statement you signed?  CBP needs only suspicion to deny entry.  They had plenty of justification for their suspicion.  I think you will be wasting your time.

Yes that’s what I assume as well. Just saw the redress program as a possible way to „fight“ a decision like that.

the lawyer btw told me that there is a way to solve the issue. He also mentioned the DHS trip inquiry . I will keep you updated

What is the way to solve this issue?

Hello guys,

just to give you a short update: the congressman did his part by reading out to the embassy and trying to put in a good word for me. Obviously he won’t be able to get my record „cleared“.

His office and the university told me to reapply for a second attempt. My lawyer said it’s also based on the embassy workers personal opinion & mood to a certain degree. I will give it a second try knowing the my changes are not good.

I want to prepare as best as possible. Would you guys maybe help me out in figuring out my strong ties to Germany?

I live with my parents as of now and both of them are not healthy anymore. My mom got sick a long time ago and my dad about 5 years ago. I want to go back to them as quick as possible. They’re still doing fine but I still want to care for them long term and for that, I have to be in Germany. Likewise with my grandparents. They live 5min away and are also old and not the healthiest anymore. I have a very strong and close connection to them and once they decide drop the house and move into assisted living (I think that is what it’s called), I will get the house. Furthermore I have the desire to work for Mercedes Benz in the same field my internship was in. This would be possible in a city like 15 mins away as I could apply there.

what do you guys think ?
