I am the visa petitioner. My AGI (adjusted gross income) is $0 for my 2021 US taxes. I am not legally required to file taxes because my income is below the limit. I have submitted my tax returns for the past two years to NVC. We already have DQ and the applicant has a visa interview in July.

 

I have a joint sponsor whose income is much higher than the income requirements according to the adjusted poverty guidelines for immigrant visas.

 

I have e-filed my 2021 federal taxes in case the immigration officer wants to see them at the applicant's visa interview.

 

I haven't filed state taxes, because I declared my employment in China under the foreign earned income exclusion.

 

Last year I e-filed state taxes for free. This year e-file options have changed and everywhere I looked does not allow me to file state taxes for free if I claim the foreign earned income exclusion.

 

Could the immigration officer ask to see my state tax return at the visa interview? I don't want to file a state tax return if the officer won't care about at the interview.

 

Are state tax returns ever required for the visa interview? I'd rather not pay $40 to file state taxes when I have no tax liability.

State tax returns are not required at interview. 

And depending on the state you are not required to file state taxes if you live abroad.
