If only it were that simple.  This process is going to take a couple years.  Get it started, and then you'll have plenty of time to learn the rest of the process.  Depending on circumstances and timing, you (family) may want or need her to move ahead with the children at the beginning of a school year, etc.  Lots to consider, but there is no hard requirement that she move before you have your visa.

Hey everyone!  Just a few quick questions I am hoping to get cleared up.  This i-130 form was actually a lot easier than I thought it was going to be.  Still some questions I am not sure about though.  If there is somewhere else that already answers these, please don't get annoyed at me.  haha.

 

1. "Where in the United States does the beneficiary intend to live." - We aren't 100% sure yet.  Is it ok to leave this blank or no?

2. "Beneficiary Class of admission" - We can't answer any of those because I don't have any of those documents.  What am I supposed to do there?

3. "At which U.S Embassy or Consulate will the beneficiary apply for an immigrant visa".  How do I find out that site?

4. "Information about beneficiary in their native written language.  If the beneficiary's native written language does not use Roman letters, upload a document with his or her name and foreign address in their native written language."  Do I just write on a piece of paper my name and address?  Is that all it's looking for?

5. "Additional Evidence" - One thing here asks for "Religious Records".  We don't have any of that.  Is that ok?

Time to read again carefully and interpret literally.  Pay attention to words like "if", "or" etc. and interpret those literally.  Note that any list of items that follows the words "In addition to the required....." are "not required".

 

Answer to your question 1, is "to be determined".

 

Question 4, cannot be answered here because we don't know the country or language.  If France, for example, enter "Not applicable".  What's the language or alphabet?

Hey everyone!  Sorry to dig up an old thread. 

 

Quick question (again) - when it comes to my wife proving she meets the min requirement for annual salary in the U.S.  Obviously she can't use what she makes in Canada, as it's a location dependent job.  I realize she would have to establish a job in the U.S to be able to prove she can meet the requirements 'in the U.S'.  Unless I am wrong about that?  I don't think I am though.

 

I am just trying to think of at what point in the process we have to do that.  So we apply for the petition, and then if we get approved and file for the actual application.  Is at that point my wife needs to have established employment the U.S and meet annual money requirement to show she can support the family.  I assume that's how it works?

Yes Montreal is strict on the petitioner demonstrating  US domicile and income. 3-6 months of regular pay slips from a US based job, plus home address, drivers licence etc at the time of the interview will usually suffice

If you have no other way to satisfy the financial sponsorship requirements besides US income, then your wife will need to find a job in the USA before submitting the affidavit of support.  Wait times for interviews in Montreal mean that she'll need to do that 8 to 12 months prior to the visa interview.

 

You....COULD wait until the petition is approved for her to do that, but it will delay your ability to get through the NVC stage and into the Montreal interview queue.

 

Essentially, the timing of her needing to be working is the length of the interview queue plus at least 3 months.

Qualified willing joint sponsor or liquid assets are the "other ways".  It's going to take several months from the time you file, until there is a need to provide any financial information.  That's why I wrote it the way I did.  Several, meaning like 10 to 12.
