Hi All,

 

I used this back in 2009 when I filed for the K1 visa for my husband. So happy this is still going and people are still out there answering questions!!

 

My husband wants to fill out a I-130 form for his parents and sister. I did read that his sister's paperwork will take up to 11 years so I am not sure if we will be doing that just yet. 

 

My question is, my husband and his family are from Colombia his father is married to another woman but separated about 40 years ago when he met my mother in law. So my in laws aren't married, when filling out the I-130 should I put separated under my father in laws application or married? And does anyone know if this is going to be an issue? 

 

Also, last question for now. They do not have passports yet (colombian) they have never traveled. Is that okay?

Answer truthfully -- FIL is separated, not married.  Just to be clear -- your in-laws had no legal/traditional wedding to each, right?  Also, is your FIL your husband's biological father and listed in your husband's birth certificate?

Beneficiary's passport is not required for the I-130 petition, but it will be required after the petition is approved, for the case to clear the NVC stage.
