hi there friends,

i just would like to ask for your help. right now, my fiance and i would like to be together. we've met on the internet and would like to apply for the K1 Visa. the only papers that he needed are his divorce decrees. will it be possible for us to apply for it even if it's only the certification that his divorce decrees are still in the process will be the one that we would submit in the embassy? please help us...we're so new with this visa processing. i'm a filipina and is now living in the philippines.

I don't really understand. Are you saying he is waiting on a divorce, or copies of the divorce papers. He has to be legally divorced at the time of submission of the petition. And copies of the divorce decrees have to be included in the I 129f petition. I would suggest you wait on the divorce or you have copies of the decree to prevent a delay with your petition.

thanks for the reply. actually, my fiance is already divorced and just waiting for the decrees. will it be possible for you to help me or give me some guidelines on how to do this application for the US K1 Visa?

I have not been a member long, and I was really confused about the process. But this website has a wealth of information that gave me the confidence and knowledge to do this myself. Use the search feature to help answer many of your questions. Beleive me the same questions you have, I had, and other people had are probably answered somewhere on this site. By all means ask if you dont find an answer. There are a lot of really smart people here(smarter than me anyway). Use the guides and Example forms on this website. Look at the blue tabs at the top. They helped me so much. Good luck with you visa.

You must submit certified copies of the divorce papers. At the time of the filing of the petition the divorce must have already been completed

Specific instructions on required documents are provided in that form. Follow ALL instructions that apply.

Wait for the completion of the divorce before filing the petition. If you do not have the certified copy of the divorce decree, this may cause an RFE while in the USCIS and it may go a long delays. :)

anneville- even more important than the divorce decrees is the requirement to prove that you've met in person at least one time in the last two years.

You say that you met on the internet but you don't say if you two have met in person. Have you?

Kaydee , is dead on make sure you have proof that you have met in person in the last 2 years also make sure you send all papers in the divorce decree and make sure they are very clear and very easy to read- good copys ...good luck .

july 1st - noa dated

july 6th - touched

july 29th -touched

august 4th -rfe

august 11th get rfe through usps need better copy of divorce decree

august 12-mail copy

august 19-email from <!--WORD2URL-01--><!--END WORD2URL-01-->uscis<!--WORD2URL-02--><!--END WORD2URL-02--> they got copy

august 22-touched again

september 29-case approved noa2 mailed

september 30 - touched

october 6th-received noa2 in mail and letter was sent to <!--WORD2URL-01--><!--END WORD2URL-01-->nvc<!--WORD2URL-02--><!--END WORD2URL-02-->

october 14th-recieve letter from <!--WORD2URL-01--><!--END WORD2URL-01-->nvc<!--WORD2URL-02--><!--END WORD2URL-02--> dated oct 11th saying petition will be sent with in a week to bogota

november 3rd - receive pack 3 and return it next day

november 17th -packet4 and interview date of dec 12th

december 12th -approved

january 5th -arrive in u.s.

january 13th - MARRIED -YAY

january 31st - should be mailing off all papers for AOS .

When you file your I-129f.. you need to provide copies of the certificate of Divorce for both parties. you if you have been divorce and fiance if he/she is divorced.

If you file and only provide documents of the divorce and not the certification it will cause a RFE.. (request for evidence) You may be risking a few things if you submit with only the document and not the certified copy. One being the RFE.. causing a delay but.. the other.. .. godforbid.. but the certified copy having a differnt date. If you are not sure.. and the certified date ends up being AFTER you have applied, then you WILL be denied based on not meeting the criteria of being Divorced prior to applying. Chances are rather slim that the date is the later.. but if the divorce is a new divorce and not simply waiting on copies of the documents.. you can be taking a risk. This will delay longer for you will have to wait for teh process of denial and then have to re-apply costing not only time but a additional fee.

Make sure 110% that the documents required is what you have.. and that you HAVE proof that you have met within the 2 yr period or .this is all a waste..

best wishes.. not fun waiting for divorce documents... .. .. We are still on hold.. waiting for documents.. now. going on 5 months since we requested finalized papers of proof.. from India. He has been divorce for over 2 yrs. but we dont have a certified copy from court.. have notarized papers.. and documents from court.. and only way to get the "certified" copy is to return to court again... .. and she / the x is .. not co-operating... aughh we will wait.. .. that is all we can do... .. but not worth risking filing without this.. correctly
