QUESTION ON EAD CARD

Hi all,

my fiancee received her EAD card with valid date starting from september 2007 and not immediately. is this correct for a k3- visa holder valid till 2009

I don't know, but... isn't she your wife, not your fiancee, if she's here on a K-3?

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

How can a K-3 visa holder be a fiance(e) as it is a spousal visa?

YMMV

I am confused, you say Fiancee, yet you indicate K-3? Wouldn't that make your fiancee your WIFE?

hi

on the card does it say expiry date...sept 2007

resident since ....sept 2007

might have to get a magnifying glass to see what it says...

if it expires sept 2007 you will have to count back from the date 90 days to remove conditions...I-751 form...

also take a look at the gallery icon at the top of the page compare your wife's EAD card with the copy there...

hope you work it out

They are talking about EAD, not Green-Card, the dates on EAD have nothing to do with when a person can lift conditions on green-card.

A K-3 may get EAD long before filing AOS for the green-card. K-3 allows up to 2 years lawful presence in the USA before having to extend the K-3, file for AOS, or return to home country for a IR-1 visa interview. The K-3 can apply for an EAD to allow work before doing one of the actions I just stated.

The EAD issued to a K-3 if filed before AOS, will expire the same date as their I-94, (Up to 2 years from entry)

i would phone them up or even scan your card and email it to them ...definetly sounds like a admin mistake ...wonder if they put the date the incorrect american way..and it was suppose to be april's date...but it still dont correspond with a february approval...

fingers crossed you get it all sorted out...

oh and dont forget to fill in your time line for your EAD and AOS...
