I gathered my certified copies of court documents as I am supposed to do to submit with my petition.(criminal records) I know that USCIS seems to want photo copies of everything, not originals, but I am a little unclear on this part. Do they want the actual “certified court copies” (with raised seals), or exact photo copies of them?

At filing they want copies of the “ Certified Court Records “ so make sure you include the stamp/ raised seal page, sometimes it’s red and on the back of the last page of records. You will send the Originals to the Consular Interview w your Fiancé for the Officer to review.

If you have any kind of criminal record , it’s good practice to :

1. Do your own FBI records ( it will show any/ all arrests) , it’s easy and inexpensive just call around to places that do livescan/ prints

2. For court records, they will want to see Sentencing Minutes/ Disposition, Charging Doc , any Plea Agreements..OR statement from the court custodian of records that says “ records destroyed, for example “

3. Request a copy of the Police Report ( if there was an arrest) from the Records Department of arresting agency…but carefully review the content ( the arrest report may indicate XYZ but perhaps DA only prosecuted for Z ) . ***would need more details of arrest/ incident to decide how you would write short explanation of events***

Thank you, this is very helpful.

I only have 2 charges. One was an underage drinking citation i got in indiana in 2015, but i did all the required community service and what not so it was dismissed. (I still printed the whole certified file to send in)

my other incident was actually in Mexico. Police arrested 4 of us on the side of the street and put us in jail because 1 of us was drinking a open container. We just paid bail and left on that one. When. Got t Mexico next week i will get a certified copy of that.

Do you think i should still do a fbi records since I know those are the only things I’ve done?

I think FBI is always a good idea , so do it. You may even avoid being asked to do biometrics / fingerprints by USCIS.

Above link is info for Mexico that should help you get started in Records for that incident. You will need to translate those records before sending them in,

When you say I may avoid being asked biometrics I’m assuming you mean for me to also submit the criminal background check with my petition?
