Doodle, since the K3 is good for two years you don't have to file AOS right away. You can file the EAD alone and wait for AOS. That's what we're doing. #1. Because my husband insists on getting a job first and paying for it himself #2. Because if they approve it after our 2nd wedding anni, he'll get the 10 yr and we'll be done with immigration until Naturalization. Sure if we file now we'll save money but in the long run we'll have paid the same amount anyways with lifting of conditions.

The K-3 still has to pay for AOS or EAD once in the US and Cr-1 doesn;t which is why the fees are more expensive up front.

Yeah the AOS will be around $1,100 and I had that all budgeted for but that is assuming he doesn't come here any earlier than mid September. I mean he CAN come sooner but we just cannot afford to file until around that timeframe. Ironic when you think about it....you're filing to allow the person to earn money 'cause he's not earning money now, yet they're charging more than even a working person could normally afford!!! :blink:

I think it's different now though. The fees go up after July 30 and the AOS includes the EAD now. I haven't researched just doing the EAD though. I"ll have to look into that 'cause that's a great idea!!

Yes, the EAD fee is included in the new AOS but you can still file EAD on its own and wait to file AOS later. If I can be done with immigration for 10 yrs, it's worth wasting the extra $180. Plus, like I said before, by the time I would have to pay for lifting of conditions the cost would be the same anyways. I'd rather kill two birds with one stone.

but more importantly I think they must have changed the requirements because in the guides on vj it states that you need to include:

4a.Copy of the receipt notice or other evidence that your Form I-485, Application for Permanent Residence, is pending. If filing at the same time as AOS (in the same package) then you do not need to provide proof of filing (how could you)! .

in the I765, so I don't think I could get away with that

He said that the fees are normally paid from the US when doing a K-3 visa, but that the consular can make his own decision during the interview.

ok that sentence makes no sense whatsoever. ####### do they make it up as they go along???? :lol:

Apparently. They are puppet-trained to not give you a direct answer. They always have to follow every statement with some kind of "the only way to know about your specific case is to send an email to the consular" disclaimer!!!

Hicham had to pay $265 EACH for the I-212 and I-601. He paid that at the time of the interview. I know this is different than your case, but I thought I would post in case it would help someone else.

Also, to anyone paying these fees...MAKE SURE YOU GET A RECEIPT!!!!!! To cover your fanny...know what I mean!?!?!

I am SO totally confused.....

My husband will be coming here, InshaAllah, on the K3. Will he be able to file for only the work permit when he gets here, or will we have to file for the AOS with the work permit included in it? It would be so much easier if he could be able to work asap, and then file for the AOS after tax time. I swear the time limits they set on you to follow are just rediculous. When they were adding hundreds of dollars to the fees we have to pay, why couldn't they have prolonged the time to do everything in too? Oh, wait, I forgot I was talking about the government for a minute. LOL

When your husband gets here, he can file AOS/EAD together. If you choose just to do the EAD first and wait to do the AOS that is fine too. The K3 is good for 2 years as long as he adjusts his status during the 2 year time.

My husband will be coming here, InshaAllah, on the K3. Will he be able to file for only the work permit when he gets here, or will we have to file for the AOS with the work permit included in it? It would be so much easier if he could be able to work asap, and then file for the AOS after tax time. I swear the time limits they set on you to follow are just rediculous. When they were adding hundreds of dollars to the fees we have to pay, why couldn't they have prolonged the time to do everything in too? Oh, wait, I forgot I was talking about the government for a minute. LOL

Maureen is correct. The work permit will take somewhere around three months to be approved. We're on month two now. So if you have the money and want to get AOS out of the way you may as well file them together. By the time you can file EAD will cost $355 alone. With AOS it's included in the fee.
