Hello. I am about to initiate my divorce proceedings, and have been trying to gather evidence to submit my I-751 with a divorce waiver. I was wondering if the evidence

 

- Two joint leases with both our names on it, from both 2020 and 2021. I also had one more from 2019, that i included with the original I-485 application, but I forgot to make copies and now I don't have a way of finding it.
 - Two Tax Return Transcripts from the IRS, filled jointly as a married couple, for the years of 2020 and 2021.
 - Verizon Phone bills under my name, with both my wife and her mother as both my dependents on the line. We are still on the same plan even though we are going through a divorce.
   The bills go from April 08, 2021, when we first signed it, until the most recent one. Over 13 months of phone bills included.
 - Pictures of two credit cards we had together, with her as my dependent.
 - Pictures from my job's life insurance, listing wife as my Spouse and dependent.
 - Copies of Drivers Licenses for both wife and I, with the same address listed.
 - A page of the USPS Informed Delivery, with pictures of mail for both of us, being delivered at the same address.
 - Pictures of several accounts that we shared, having different profiles on the same account. Such as Hulu, Netflix, Amazon Prime.
 - Pictures of my Emergency Contacts of some of the jobs i had,  listing my Wife as my emergency contact.
 - Several pictures that spam from the very start of our relationship, to the very last picture we took of us together, during the concert we went to in February of 2022.

 

 We never had a joint bank account. We had a joint credit account under my bank, but it was a credit card we used to build credit, and there were barely any purchases made on her card.
 We had cards for my Vision Insurance plan from when i used to work as a contractor for Amazon. She was listed as my dependent, but i wasn't able to locate those.
 I also had her listed as my dependent on my Walmart Life Insurance policy back from when i used to work at Walmart. I do not work there anymore and could not get access to those documents.

 

I have included around 70 pictures of us, that dates from the very start of the relationship, to our wedding day, until the very last pictures we took together. Her family is also with us in several of those pictures.

 

This is pretty much all i was able to gather, and i don't think i am able to provide any more evidence than this. Was hoping to be able to get some facebook posts from my ex, but she untagged herself from every picture on her family's profile, and deleted her facebook account.

 

I was wondering if this is enough evidence, and or if there are any tips from any of you who went through this, if there is anything else i can add. The marriage lasted a bit over two years by the way. We actually completed 3 years two months ago, but were already separated then.

When does your conditional green card expire?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Perfect.  Once you get your divorce decree, you can immediately file for removal of conditions.....

Awesome. That is what i plan on doing. Do you think the evidence i have provided above is enough?

Some additional things you can try to obtain based on your list :

1. Verification of Tenancy ( both names ) from the first lease landlord ( 2019) You can Google a standard form and approach the old landlord for signature. It basically states Mr. X and Mrs Y rented at 123 happy lane from X to y period. 
 

2. Same Verification of Tenancy Letter for Leases in 2020/2021 

 

3. Any cancelled checks / bank drafts or receipts of rent payments for above listed leases

 

4. Any utility bills ( gas , electric, water, internet) for 2019, 2020, 2021 and 2022 ( or up to period of separation) , no matter whose name they were in , they show the shared address. If any utilities were included in the rent then add that info in the Tenancy Letter Verification ( usually also part of lease terms so it will match) 

 

5. The credit card statements ( call companies and have them send you copies of all statements for 2019, 2020, 2021, 2022) pick 3 complete statements for each year example ( January, June and December) , again they will show shared address. If spouse has separate credit accounts as her to get copies for you 
 

6. Bank statements for 2019, 2020 , 2021, 2022( use same rule of 3 per year ) and add short explanation as to reason you did not have joint bank accounts…( example joint decision, .or ) . Ask your spouse if she is willing to provide you with copies of her own accounts ( use same 3 statements per year rule) for the period. 

 

7. Any record ( receipts)  OR short explanation of how you two co mingled assets/ liabilities..where did her paycheck get deposited, where did yours …how / who made payments for RENT/ UTILITIES/ FOOD/ CAR expenses ( insurance/gas/repairs) 

 

8. Car Registration for yours and her car along with auto insurance POLICY and PREMIUM payments for 2019/2020/2021/2022 ( any car loans) or short explanation  of how vesting / title is held ( example that each owned vehicle prior to marriage ) 

 

9. A few  Copy of any paystubs from the years for both of you ( if possible) if not, yours is ok to show shared address.

 

10.  Affidavits from neighbors/ friends/ family or church, people that knew you as a married couple to include any specific activities you and person attesting did together ( ex Mr X and Mrs Y attended our sons birthday party on 12th of Honeymoon Month or we attended their Xmas dinner …) Best if Affidavit are Notarized with a JURAT ( not reg notary acknowledgment). 
 

11. Any Costco/ AAA/ gym / church or other memberships? 
 

12. IF ex is willing to , she can write an Affidavit in support of your I-751 , basically stating “ Yes we married in good faith, shared our life for x years  but we have decided to divorce..

 

13. Any info on Health Insurance Plans ( either of you had ) or go in person to any doctors office/ emergency room / eyeglass store that either of you got services from and see if you can get something for the years in question.

 

*****You mentioned you have not started Divorce Proceedings..so I would recommend you get that done ASAP if there is no hope for the marriage because once you file w divorce waiver, u will get RFEd to produce Judgement …so hopefully it’s an amicable-  joint  “ let’s get this over with quickly “  or lots careful monitoring of your I-751 RFEs and pleading for additional time. *******

Thank you for reply. I will try and obtain the most of what you suggested. Might be difficult to obtain the first one, because we moved across the country after the first apartment we had, and us and the landlord didn't exactly left on the best terms.

I should be able to come up with most of the rest though. I will try and have my ex help me with obtaining some of her documents and i hope she cooperates. I also have already requested and received copies of both I-485/I-130 submissions. And I should be filling for divorce next week. It is amicable and we both want to get it over with as quickly as possible.

Even “ a bad landlord ending “ is solid evidence but don’t stress over it. The important part is to cover your TIMELINE from date of LPR card…in a through way  and document your life realistically. 

 

.  A notarized Affidavit from your spouse is very valuable ( NOT NECESSARY, do don’t stress) , so if she is willing get it now and hopefully it includes short statement and a few details  for decisions  such as : no joint bank accounts, how she chose to deal w paycheck/ household expenses.

You may also want to include screenshots of your text messages between you and your spouse. My interviewer readily took them when I brought them to the interview; however, I think it's the least important.
