A bit more to getting an expedite approved that just having a job offer

He's fine to stay and adjust status. Intent was determined at the border.

Okay good to know. When should he stop working for his Irish company then? Before we even file for I-130 / I-485 etc or maybe when application for I-130 is approved?

Technically, as soon as he sets foot in the US.

Expedite requests are never guaranteed, but having a job offer greatly increases your chance of getting approved.  The request itself is not complicated.  Just call the USCIS hotline or ask Emma on the USCIS website.

This is in violation of the terms of ESTA/VWP.

 

He needs work authorization, which will take around 8 months if you marry and adjust status.   It is a drawback of doing things that way.

Just because you request an expedite, doesn't mean it will be granted. You need to prove extreme financial hardship.

If he cannot afford to wait for an EAD, then perhaps a CR-1/IR-1  would be a better choice.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
