Will people entering the USA under the Ukrainian Humanitarian Parole program have special restrictions?

My assumption is that if they want to leave for a time, they only must request advanced parole. 

 

How long does it typically take for advanced parole to be approved?

 

How long does it typically take to get an authorization to work?

Advance Parole, for people qualified to apply,  has been taking as long as 8 months.

"The US immigration process requires a great deal of knowledge, planning, time, patience, and a significant amount of money.  It is quite a journey!"

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Keep in mind that advance parole might not be an option for Ukrainians paroled into the US using the "Uniting for Ukraine" program.

Terminating Your Parole

If you have already been paroled into the United States, your parole will automatically be terminated if: 

  • You depart the United States without obtaining advance authorization to travel; or
  • Your parole period expires.

The parole is permission to enter the US at that specific time with additional restrictions on validity (period during which it's active). It might be possible to use it multiple times, but that's dependent on the received documents and their conditions, which we haven't yet seen (at least on this forum and publicly...). beyond the employment authorization, I don't see if it grants any more benefits...

Ukrainians who receive advance authorization to travel to the United States to seek parole at a port of entry will have a specified period of 90 days during which the authorization is valid.  Individuals who do not travel within the 90-day period will be required to begin the process again with their supporter filing Form I-134 with USCIS.

- Generally, yes there are restrictions.

- Yes, they would have to apply for advanced parole. From my understanding they would be eligible to apply.

- I have heard advanced parole is take 3 months or more

- I'm not sure how long on work authorization. I've heard what I think are various theories on how the process will work for Uniting for Ukraine beneficiaries.

I would be genuiinely be interested to confirm whether they are eligible or not. Because...

  • In possession of a previously issued reentry permit or refugee travel document which is still valid, unless it was returned to USCIS or it is demonstrated that it was lost;

  • Under removal proceedings.

Because technically they do have a refugee travel document, which is the humanitarian parole (IDK if that classifies), and also parole is not an immigration status, and AFAIK this is not TPS:

This topic is also of interest to me as we are trying to bring my stepdaughter here under the U4U program... and at the same time, she has qualified (with a very high case number) for the Diversity Lottery. 

 

IF she is able to come to the US under U4U and then IF she is selected for DV interview, I can only assume that she would have to pursue Consular Processing (as opposed to AOS in the US) because she would have no valid immigrant status under Humanitarian Parole... so, to attend her interview, she would have to fly to a foreign consulate with no way to return to the US if her green card visa is declined.

 

Lots of "IF" in this scenario, but this issue about being not/able to get advance parole is sort of a hot topic for us.

My wife and her children came via Humanitarian parole in April, 2022 (pre- United for Ukraine). We married in June and applied for AOS in October. My wife received her green card this February and I am wondering if the kids' will take much longer. Does anyone have any ideas?

Have you contacted your Congressman's immigration liaison?  That's the best avenue for learning the whole story.
