Canadian Marries American, Wonders About Medical (I-693)

Previous Thread: This thread follows on from my previous thread here.

Brief Summary: I am a Canadian and I came down to Kentucky to live with K for a while. After two months, I realized I could not live without K, and we married on July 10th. Now I'm looking at a mass of forms concerning AOS (Adjustment of Status) and a gigantic fee increase if I don't get them all completed by July 30th.

What I Think I Have to Do: It seems to me that I have to submit these packages (indents indicate forms required by other forms):

I-130 Petition for Alien Relative

-- G-325A Biographic Information (one for K & one for me, with photos)

I-485 Application to Register Permanent Residence or Adjust Status

-- G-325A Biographic Information (for me, with photo)

-- I-864 Affidavit of Support (K has a steady job)

-- I-693 Medical Examination of Aliens Seeking Adjustment of Status

Optional simultaneous filings

I-765 Application for Employment Authorization

I-131 Application for Travel Document

(If I've said something incorrect above, please let me know!)

My Dilemma: Most of this seems fairly straight-forward, but when I looked into the I-693, I found a reference to "Appendix A, Supplemental Form to I-693". My doctor is in Canada, and any records I have of immunization during the 1960's would be in my apartment in Toronto.

My Question: Since I did not come here with the "intent to immigrate", I did not bring along detailed medical records. Am I going to have to go back to Canada to get them!?

(... and if I do have to go back to Canada to dig up those records, it means I can't come back, since I would then have an "intent to immigrate"!)

You'll need to get a medical exam from one of the civil surgeons on the USCIS list. You can ask the civil surgeon to do a titre test to determine what vaccinations will not be required. You can have the vaccinations that are still required and the civil surgeon will accomplish an I-693A to show that you are up to date on all vaccinations.

Follow John's advice above.

And as a petitioner for adjustment based upon a marriage not previously 'blessed' by DHS, please research and/or seek legal counsel regarding travelling back to Canada prior to receiving your greencard - I-131 or not.

I got the list of Civil Surgeons "near" here. (We live in the wilds of Appalachia, so "near" means over an hour's drive.) I'll be phoning around today, and I'll ask about that titre test. Thanks for the comment!

My research has made it abundantly clear that I can shoot myself in the foot by going back to Canada at the wrong time. I'd rather not shoot myself in the foot. I think the Civil Surgeon would notice that. :blink:

And if you are trying to beat the new fees I would hurry on making an appointment with a CS, a lot of offices are backed up with appointments.

Try to contact your doctor in Canada, they might have a record of what you're up to date with.

If you had a BCG vaccine done when younger, keep in mind that you will need the TB skin test (now mandatory) AND the chest X-ray if positive (likely if BCG).

If you are on health insurrance or have one yourself you can contact the CS and see if it's possible for you to do the TB test and the titre test before showing up at their office. It might save you some time, but do make sure the CS accept it first and that the (non CS) doctor writes a letter saying that he/she checked your identity (better safe than sorry).

My wife is also Canadian and we are about to go thru the same process. My question is if this medical form has to be filled out and sent in with the rest (485, 131, 130, etc) or this is something we do later.

Pretty much - Does she have to get her exam before or during the application process?

Glad I know that now. I'll have to find someone who can give her an exam ASAP so I still make the July 30 deadline

i know this is an old post but I just wanted to let people know that if you need a copy of your vaccination records and your from ontario. Contact OHIP and they can fax you a copy of them. (I had to do that for my CNA class)
