seems like filing for K-3 was a mistake

The Immigration bill was such a joke , engineered by millionaire congressmen with no term limits. How many of the 12 million would actually go back to their homeland and have to go through something like this to re-enter and then pay or could afford the 5 thousand dollar fine on top of it ! How many of them have criminal records ? Kinda sad that our loved ones are treated and scrutinized like they are the potential terrorists.

The thing that bothers my wife and I the most about this process, is not the wait per se. It's the fact that they have taken all this time away from us and we can never get it back. It feels very much like one of us has been in prison this whole time even though we didn't commit any type of crime. It's just really a shame that the powers that be don't think this is a big enough problem to do anything about. I can say overall, it's really made me lose faith in our government.

I did some further analysis...

If I do this search for all service centers for March, I find 39 total IR-1/CR-1 records (4 of which really appear to be K3 records since they also have I-129F filed). I count 25 NOA2s for I-130 or a total of 25/35 approvals or 71%

If I do this search for all service centers for March, I find 50 total K3 records. I count 1 NOA2 for I-129F only, 5 NOA2s for both I-130 and I0129F, and 11 NOA2s for I-130 only, for a total of 17/50 approvals or 34%.

So, it seems that unlike what I said previously, there IS a difference in processing times at this moment. It was about the same when I ran this a couple weeks ago, but now many new CR-1/IR-1 approvals have come in and it's changed completely. It will be interesting to see how this develops in the future.

I can say one thing though...it's very frustrating that no matter which path you decide to take in this immigration process, it seems that there is always something that USCIS does that makes that path suck equally as bad as all the rest...there is no clear cut best way to do this and the problems with each path are constantly changing.

For example, if you file I-130 only, it can take a really really long time or may even come to a complete stop.

If you file K3 and follow it all the way through only pursuing K3, (which is supposed to be quicker), it now seems it is taking longer to get approved than the I-130. So any time you might make up at the NVC gets lost in the USCIS. Way to go guys! lol

If you file K3, but really want to pursue I-130...think again. I-130 will stop being processed unless you file another form to start it moving again...which adds a nice fat 6 month+ wait to your time making it completely useless! Again...good job USCIS!

They really get you no matter what you do. Honestly, they couldn't do much worse if they tried, and I really do wonder if this whole mess is on purpose! Ok...I'm going to try hard to not rant any more about this tonight...but you all know what I'm talking about!

Just posted this in the May/June thread but figured i'd also include it here for comments

Members who had their I-129F approved in:

Jan 2007. 5 members in VSC approved in 57 days and 5 members in CSC approved in 107 days (CSC twice as slow!)

Feb 2007. 6 members in VSC approved in 47 days and 20 members in CSC approved in 90 days (both improved)

Mar 2007. 7 members in VSC approved in 67 days and 4 members in CSC approved in 121 days (both slowed down)

Apr 2007. 6 members in VSC approved in 45 days and 30 members in CSC approved in 84 days (both improved especially CSC)

May 2007. 8 members in VSC approved in 84 days and 8 members in CSC approved in 84 days (CSC stays consistent but VSC slows down a lot and matched CSC)

Jun 2007. 6 members in VSC approved in 151 days and 6 members in CSC approved in 116 days (both slow down but VSC is stalling!)

hmmm when i look around now i see people who only file the I-130 get an approval at a much faster rate then those who file both the I-130 and I-129.

I have been waiting for over 4 months for an approval... and this point it seems that my I-129 will take the same amount of time to process as my sole I-130 would have taken. Am i correct?

seriously, this K-3 visa thing needs to be scrapped since its not doing what it was intended for.

When I did the K3/K4 the I-130 was a LOT slower. That's why they implemented the LIFE ACT for K3.

We went with the K3/K4 but even tho it was a bit faster we both wish we'd gone with the CRs.

We went thru hell adjusting status as USCIS screwed most everything up.

Cost us a LOT more money and a LOT more stress we wouldn't have had if wife and daughter would have got their GCs and SSN in the mail within a short time of arrival.

Heck! You can be denied at the AOS interview.

Have to deal with dumb civil surgeons, No working, drivers license, health insurance without SSN and GC.

They screwed up also and took their I-94 at the interview and said they'd have to get AP if they wanted to go home for an emergency!

BOTTOMLINE IS K3s SUCK BIGTIME!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

What you guys need to really compare is interview dates and not the actual approval dates. Everyone needs to remember the NVC has to process CR1/IR1 and the K-3 only passes through the NVC and gets to the consulate much faster.

True! Also consider that some consulates have a huge backlog, such as Ciudad Juarez in Mexico. Over there it takes about a year to get a CR-1/IR-1 interview. It only took us 3 months to get a K-3 interview. For us, it was definitely worth getting a K-3 visa.

We don't have a problem with paying $180 more, but it would be nice, if it would help! The problem is, if they approve your I-130 before your I-129F (which actually is the norm), they are stopping working on your I-129F and you have to go the CR1-way.
