My husband overstayed his visa in South Korea can he still be approved for a CR-1?

i did say in earlier post my case was sent back to USA for a NOID -notice of intent to deny

reason- big age difference

 

i appealed and won

married over 12 years and he's a citizen

 

overcoming any obsticle immigration can throw at u is a matter of knowing things that can help like the 601 waiver

how to fight a NOIR or NOID

all 3 of the above have to have REAL and VALID documentation to prove your case is just 

CO said my husband did not know what books i read (stupid) but i produced a dated text message showing i was researching and reading online to help my mom as was writing a book

 

CO wants proofs not statements 

our government likes a paper trail of evidence for any visa

Thank you so much for handling this. It was causing me much more stress on an already very stressful situation. I just lost a baby I do not need more stress. My body cannot handle it. I appreciate you stepping in.

What is ROK? We have 8 years of messages pictures video calls and so on. We split up due to the distance and lack of money to be able to buy tickets for me to see him. Its been a rough road. But we love each other I think we can prove that part. He went to korea when we were not together. Will that still make them suspicious you think? It’s been very hard on us but we both keep going back to one another now we finally had enough money to spend real time together and things are going very well. So I hope they can take into consideration that I was not financially able to maintain our relationship consistently for the entire 8 years. Had I been able to fly out here more consistently we wouldn’t have had these break ups. It’s very hard loving someone and trusting someone you cannot see for YEARS at a time  🥺💔

ROK = Republic of Korea

 

And I believe that Dept of State/Dept Homeland Security understand that every relationship is unique, that sometimes they go through rocky periods and that the distance is a stressor for a relationship. Extensive history going back 8 years definitely helps back up your case. I'd focus on presenting your case with evidence that covers across that 8 year period. You don't need to highlight the periods of breakups in your evidence, you need to provide evidence that *supports* your relationship, not evidence that undermines your case.

He had no choice they didn’t approve him to stay… apparently they don’t really approve that in Korea

I understand that I am not here to prepare for the interview at this time. Does my question sound as though I’m asking for a mock interview?!????
