Hello, 
I was wondering if Direct Consular Filing is available in Morocco? I am a US citizen, newly wedded with my Moroccan husband residing in Casablanca, currently undergoing the process of obtaining carte sejour. I intend to live in Morocco with my husband until a green card is issued. How do I go about the process for filing a DCF? How do I go about filing petitions outside of the US?

Step 1:  The consulate must agree to accept your case.  You will need exceptional circumstances. 

For complete clarity, visas are issued at the consulate.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Exceptional circumstances:

1.  Military:  USC is about to deploy

2.  medical -one or the other faces emergency medical treatment in the US

3.  threats to personal safety - can not use this one as u are willing to live in Moroc so u must feel safe

4.  close to aging out

5. petitioner has recently naturalized

6.  petitioner adopted a child and needs to immediately depart the country

7. Petitioner USC has short notice of new job in the US and needs to immediately report to US

 

The above is not an exhaustive list of examples. The Consular Section retains the discretion to accept an I-130 for compelling humanitarian reasons, including natural disasters, widespread civil unrest and other largescale crises.

 

 

Basically u need to apply ASAP online and get the ball rolling

Maintain your US residence with valid state ID,  US bank account,  deed to property or lease of apartment (or status to live with family)

for the next 2 years do your US tax returns 

Have a  income to support your petition according to the poverty guidelines and / or have a joint sponsor wiling to sign a I 864 and provide their IRS transcripts

Actually, they need to talk to the Consulate first.  The OP has not added any additional detail, so we do not have any idea if they might qualify for DCF.  If they submit an I130 online first, then the Consulate will not accept a DCF request.

Getting the Casa consulate to talk to anyone is next to impossible even if she emails to

by the time she gets an answer , she could be wasting a lot of time if all she wants is to do DFC and no special circumstances except a marriage

hopefully she'll come back and let us know

I don't disagree as I don't have any first hand knowledge of that Consulate, are they this bad in communicating when a DCF is requested?  My only point is if they immediately file the I130, the OP gives up any hope of DCF if they indeed have an exceptional circumstance.

she needs to file now as she doesn't fit # 1-7 as i wrote

Medical for him to get a visa for him for treatment?  dr would get in touch with US hospital and arrange a non immigrant visa

she isn't military

she isn't afraid of her own (or his safety) as she is willing to stay in Morocco

CR1 is not aging out as not even applied for

she didn't just naturalize to change for LPR adjusting a change in visa type (no spouse visa applied for yet)

she didn't adopt and need to depart/ she married and is going to stay till he has a visa

she isn't talking about a job she has to start  as she is staying in Moroc

 

there are no humanitarian reasons,  no crisis in Moroc,  no natural disaster, no civil war

basically no reason for a DCF

she needs to go thru the system same as any of us 

 

i found the reasons for expediting a DCF by googling the question

"What is needed to DCF"  the french embassy stated the above and then i check 2 other embassies that do not ordinarily do DFC and they posted  close to  the same reasons leaving out the adoption section

You very well may be right, my only point was that we know very little about the OP's history and they have not returned to add to it.  I read the other posts, and that did not answer my question as to how the Casablanca consulate responds to requests to accept an I130.

 

I tend to agree, it is probably not an option, but stranger things have happened when we don't know the entire story.

Please let us know how u make out doing the carte sejour. as the work and documents to go thru the process are as extensive as the process for getting married in Moroc 

it could help any of those who plan to go thru the same steps to make sure they have all US documents for carte sejour. also following the marriage documents 

helpful to also let us know the cost u paid for translations per page 

also the fee stated in instuctions is 100 dh (which is only $10 +/- ) with the renewable fee in a year of the same amount but one woman states she had to pay 300 dh which i assume an officer duped her into paying "under the table"  

 

 

reason for asking is 

i thought to also do this but my birth certificate ,  US criminal report ,   etc  and other originals were turned in with my application to marry and kept by the Judge to submit to Rabat 

so i should have taken duplicates for the carte sejour.

 

letting others know what happens and if a smooth or rocky process may help others who follow u
