The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.”

Yes.  And California for example has passed laws that guarantee abortion rights through the 270 days of gestation if not beyond.  
 

However, most Americans aren’t not in favor of abortion techniques used on a fetus 240+ days old and so I would expect scotus in the future to rule that such procedures are violate the fetus’s right to life.

Back in December 2021, the national review says this didn’t happen.

Such as?  So, maybe one of the liberal Justices?  No, I think a clerk is the culprit. This was an attempt to pressure Justices to change his/her vote.  This was an activist.

Strangely enough several theories popped up last night, and they continue around the rumor mill this morning. Some are questioning why it was given to Politico than the usual suspects. Why couldn't a justice leak it? Why couldn't a justice's family member leak it? Why couldn't this draft information have been passed around to numerous third parties on either side and the leak occurred there? Has there been a security breach? Will the FBI get involved? If this opinion was decided in Feb, why is it still being sat on? Some have suggested if you leaked the document in order to sway a justice's opinion, that would seem to be a useless gesture. The justices have already made up their minds and changing their mind based on a document leak would only weaken the institution. Furthermore, many people have been speculating for months that this was coming and was glaringly obvious.

 

Early last night some wondered if the document was real at all or if it were a breach from a state actor or agent. But sure, it could also be a clerk, but it also might not be a clerk. And yes, has someone's data been compromised? There is also an additional leak to CNN about deliberation processes.

I think we have different definitions of leaking and leaker.  Anyone who shares the opinion with a third party is the leaker not the third party.   Any justice sho shares the opinion with a family member is the leaker not the family member.

So in the original Roe, a final decision was leaked hours before that decision was officially announced, vs. a draft opinion being leaked months ahead of a final decision and after additional discussion?  Doesn't really seem to be a similar situation.  This recent leak has more impact on deliberations of the Court as a decision is decided vs one that was leaked after that decision was reached.

I expect there will be a new industry cropping up if this ends up being the final decision, abortion tourism.  I can see the ads for CA and NY now.
