I've freaked myself out a bit reading this - https://cliniclegal.org/resources/family-based-immigration-law/tax-transcripts-vs-tax-returns

In our submission to NVC we only provided 3 years of tax returns, not tax transcripts. Has anyone had trouble with this for their I-130?

Thanks

Khali

According to the I130 instructions .. you can submit either the1. tax transcripts

OR

2. the tax return with all associated W2 and 1099 forms

Sometimes an RFE is sent requesting transcripts anyway .. no rhyme or reason .. but either is stated as acceptable documentation.  Often filers fail

to send all the W2 etc.. thats why transcripts are easier, as this info in included in the IRS transcript

I don't think we submitted W2 because I live/work in New Zealand and don't have those. We just submitted everything in our tax returns. I'm so stressed through hopefully we don't get an RFE

You will probably get an RFE for W2s and for proof of income.

You should upload a statement explaining why you don't have W2s/1099s and you should upload proof of employment/income from New Zealand.

You can search the forums for example letters of what you should write.

You will go back to the end of the NVC line and have to wait another 80 or so days. If you upload before they review your documents you won't reset the waiting time.

Great thanks. I'll upload transcripts now as we're still in the queue.

If you do not have W2s/1099s for 2021 and have not received your 2021 transcript make sure to upload the statement explaining why you don't have W2s.

NVC instructions state you need to upload W2s if you upload the tax return.
