My case is currently at NVC and reads as CR1 because we haven’t been married for longer than two years. Our anniversary will be in August. 
 

I highly doubt that I will receive my green card before our second wedding anniversary with the way timelines are going currently. 
 

Will I receive an IR  green card if the process  ends up going past our two years anniversary or will I still only receive my conditional green card because it says CR1 now?

04/22/22 - NVC received + paid
04/29/22 - Submitted DS-260 
09/15/22 - Case completed at NVC

11/17/22 - Interview date
Approved on the spot! 🥳

A 10 year Green Card will be issued if the spousal visa holder applicant ENTERS THE US ON OR AFTER 2 YEARS OF MARRIAGE.   Those are the rules.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The 2yr vs 10yr GC associated with a spousal visa is determined by the date of US entry using the spousal visa as compared to the wedding anniversary.  So even if the interview occurs prior to the 2nd anniversary, if the immigrant enters the US on the visa after the 2yr wedding anniversary, they are entitled to a 10yr GC.  If you end up in this boat with a CR1 printed on the visa, but entry after the 2nd anniversary, you may want to remind CBP that you should get a 10yr GC.

we were married at the approved visa interview for over 2 years and the visa , itself ,  was marked as IR1(on the right side under visa category)

do not  be afraid to point it out to the CO that its a IR1 if u interview after the 2nd anniversary if u are approved 

 

CBP also writes IR1 on on top of the entry stamp

 

just looked at his old passport with the visa in it to verify all this

Note that CR1 and IR1 are both visa categories and immigrant status.  You can be issued a CR1 visa, but have IR1 status upon entry.  Note also that you are waiting for a visa interview.  Getting the green card is something that happens after you receive and use the visa.
