ys that’s correct my wife is document qualified December 21 2021 ir1 and waiting 15 months at the moment

Holy cow . My wife immigrated 5 years ago. It took me 1 year exactly from the time I filed her I-130.

Why the hell it’s taking 3 years now ??. That’s absurd

3 years?🤣 my wife is waiting since oct 2019  and she most likely still has another year left. Its taking 2 years JUST FOR INTERVIEW at Islamabad. Embassy is slow because they are short staffed and because afghanistan embassy shut down and now all those afghan cases are going to islamabad so thats why.

my husband was DQ'd in November 2022, and i honestly cant wait 2 or more years to see him again! ive already spent the last 8 months away from him and its torture. does anyone know if we are allowed to travel back to pakistan, and how long we are allowed to stay there while waiting for an IL?

What do you mean if you are allowed to travel back to pakistan and how long are you allowed to stay there?

if your a US citizen you can go travel back to pakistan and stay as long as you want

If your US green card holder than you can go for max 6 months to pakistan there are ways around this though you can file with uscis and you can stay up to i believe 1 year BUT I WOULD NOT DO THIS because it can cause problems for your US citizenship.

Sorry but nothing we can do about the slow wait times at islamabad embassy, the process right now is about 20-24 months,  my wifes been waiting 13 months so others have been waiting longer.

thanks for your response! i'm a US citizen, but i was told by someone that i can't leave the country for more than a month, otherwise it messes with my "domicile". I dont want to sound redundant but I just need actual confirmation that this statement is not true, as it would be extremely costly for me to fly back and forth multiple times throughout the year. So you're saying that while waiting for an IL, i can just go and live in Pakistan with my husband (est. 20-24 months)?

Yes thats exactly what im saying, if you have a USA passport you can go to pakistan and live for as long as you want, domicile is only needed when your applying for a USA passport but you already have one so that does not apply to you. I have visited my wife 5 times since i applied for her IR1 visa case.

@howmuchlonger! Yes that's true with your American passport u can live as much as u wants just make sure that  u have joint sponsor or go get job before interview bc you have to give AOS with your paystubs at interview  to show them you can sponsor your husband or wife, that's my understanding if anyone knows otherwise please share.thx.

Hi! Thanks for replying :) i do have a joint sponsor already, and am currently working, but if i move back then i’d have to leave that job. But considering i have the joint sponsor then it shouldnt be an issue right? And i plan on coming back a month before my husbands interview so that i can set up a place for us. I did that recently thinking we would get the IL within a month of being DQ’d as thats what their website said, and then later stumbled upon this page after waiting for months. So i dont really see a point in me living alone and so far away from him for an indefinite period of time. First they ask us to prove how real our relationship is and then put us through this torture of being away from one another. Sorry for the rant, im just honestly fed up and this forum really has provided me with a lot of my questions no one could seem to answer. Its comforting to know im not alone in this boat

Yep thats true since she already has a joint sponsor than it should matter if she has a job or not.

You should do some extensive research about domicile. This is a good place to start:

https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/i-864-affidavit-faqs.html#aos19

If i was you i would go back to Pakistan and spend time with your husband. 2 years is a long time to wait and its brutal specially when you are newly wed

Go to Pakistan, maintain bank accounts etc in USA and come back few months before expected interview. Get a job and you will be easily meet the domicile requirement.

good luck

She doesnt need to prove domicile she already has a US passport and she already has a joint sponsor for her AOS, so she doesnt need domicile at all.

Thankyou all so much for your support and responses! It really means a lot!
When i initially filed my AOS with a joint sponsor on CEAC, i was told i didnt meet domicile requirements since i was living in Pakistan for the past 7 years for medical school and then covid happened. But i moved back to the US in September after that notice and re-established my domicile and the NVC Approved it when we were DQ’d. Thats the only thing i dont want to mess up if i do move back until the IL arrives. Since ill have to let go of the job as well the place im renting. But these 2 things i can re establish once we know when the interview will be and i come back a month before. I really hope all of our cases process faster and that the embassy speeds up so we can all be reunited with our spouses soon iA 💜

Wow i have never heard of that but i know terms of AOS only the joint sponsor must prove that they have a job and if they have a job than this proves domicile. I never heard about US citizens needing to prove domicile to sponsor their spouse or family member to come to USA. @pushbrk@Chancycan you guys confirm this?
