I had case of Simple Assault. It will be resolved; can I then file I-129F? [edited title]

I have an question also I don't know how to ask , Im new here .

I am a US Citizen ..

2 years ago i divorce after divorce i go to ex husband's place to see my child .

I'm outside the house he called police and i arrest two times he put case on me of

 " Simple Assault" 

but now last month ago I engage..

and before filled petition i want to remove charge.

 

my ex husband also agree he says Infront of judge that i want to withdraw my case .

judge say that like to me you have pay pay fine. 

i said ok.

 

now after clear can I filled i-129f petition to bring my future husband into US.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You can, but you have to disclose your record. As per I-129f instructions:

 

Indicate whether you have ever been the subject of a temporary or permanent protection order or restraining order (either civil or criminal) related to any of the crimes specified below, or arrested, or convicted of any of the crimes specified below. If you were ever arrested or convicted of any of the specified crimes, you must submit certified copies of all court and police records showing the charges and disposition for every arrest or conviction. You must do so even if your records were sealed, expunged, or otherwise cleared, and regardless of whether anyone, including a judge, law enforcement officer, or attorney, informed you that you no longer have a criminal record.

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

After re- reading the instructions, it seems to me that it all depends on if it was categorized as “domestic violence” (at least the part that I’m reading with regards to “specific crimes”). However, my understanding is that you have to disclose this charge regardless of the instructions

You posted that you were arrested twice, but seems only one resulted in charges being filed. The arrest records more than likely were marked as domestic violence ( look at your police reports at the top left of the first page and you will see some codes / words)..but even if they were not it will be “looked “ at as such since it involved ex and children. You would need to provide the arrest records, extensive court records  w charging documents, any plea agreements, not just sentencing mintutes and of course some argument that you do not pose a danger to your fiancé…may have some delays at USCIS and still end up with the uncertainty of Consular discretion.

 

All things considered, if your fiancé is a keeper and you don’t need the personal safety net of the 90 “ trial run” relationship test, then it is more practical  to just marry the fellow and file an I-130 Spousal , because once bonafides are in place , you are no longer at the mercy of “ discretion  of Consulate “:

u can file when u have the court disposition of your case if  have met him in person in the last 2 years
